COBALT advised its client (international chain of fertility clinics) in a legal dispute with its former employee regarding certain aspects of termination. The employee submitted a termination notice on the grounds of public morals and ethics due to the fact that the employee’s suspension was allegedly unfair and illegal. The employee also claimed a severance payment in the amount of c.a. EUR 35 000. The first two court instances ruled in the employee’s favour, however, the Supreme Court supported our client’s position that the employee’s termination notice is to be regarded invalid and the claim for severance payment is ungrounded.
