COBALT manages to refute alleged discrimination of an employee

COBALT advised the Latvian subsidiary of an international company regarding termination of employment with a disabled person. The assignment also included representation of the client’s interests in the court. On 18 August 2016 the Supreme Court of the Republic of Latvia upheld the judgment of the Regional Court by refusing the claim brought by the employee against the client regarding unfair discrimination.

COBALT employment law experts successfully represented the client in all court instances by proving that no action taken by the employer regarding the employee has been based on any kind of discrimination. The court concluded that a company has every right to make independent business decisions, and an employer does not have an obligation to ensure a permanent job position and tasks for an employee if it is no longer commercially justified for the employer.
