COBALT advised an international insurance company regarding termination of the Latvian branch manager and represented the client in the court regarding the manager’s claim for invalidation of termination notice. The case was unique in a sense that previously courts had not ruled on situations where the dismissed person is a manager of the Latvian branch of a foreign company. It had to be decided whether the position of the branch manager is in essence similar to that of the Management Board member and whether branch managers can be terminated at will irrespective of their employment contracts. The court has adopted its final ruling in favour of the client, thus forming new court practice for similar cases in the future.
