COBALT advised and represented Nuctech Warsaw Company Limited Sp. z o.o. in Tallinn Airport’s public procurement “Registreeritud pagasi EDS läbivalgustusseadmete ostmine Tallinna lennujaama” (Purchase of checked luggage EDS baggage-scanning equipment for Tallinn Airport). With the procurement, Tallinn Airport purchased two baggage-scanning devices that meet modern requirements. The contract between Tallinn Airport and Nuctech Warsaw was signed on 30 January 2020, at the cost of approximately €1.9 million, plus VAT.

During the procurement arose a dispute over the conformity of the proposed equipment. Both the Public Procurement Review Committee and the administrative court ruled in favour of Nuctech, which allowed our client to sign the procurement contract with the contracting authority.

Our client gave the following feedback on work done: “Aside from extremely professional and flawless legal support, we must also emphasise the commitment, openness and cheerfulness throughout the complex and stressful process, regardless of the day of the week or time of day (which is very important when working with Chinese people in particular, because they are also committed to the job, regardless of the time, and they highly appreciate this also in their partners, especially knowing that this is not culturally common in Europe). The extremely positive attitude of the lawyer eased the tension of all of us in Nuctech and helped to overcome all difficulties confidently.”

Nuctech Warsaw, part of the Chinese hi-tech enterprise Nuctech, is a global provider of technology services in the areas of security and inspection for customs, airports, ports, railways and major events.

The client was advised by Senior Associate Kadri Matteus.
