COBALT successfully represented the Head of the Migration Department Evelina Gudzinskaitė, who achieved a significant victory over the Ministry of the Interior. The Head of the Migration Department sought from the court quashing of the order of the Minister of the Interior Eimutis Misiūnas dated 21 March 2018, by which E. Gudzinskaitė’s qualification class 3 was revoked and which meant a reduction of her salary by 15%.
The Vilnius Regional Administrative Court ruled that career development of E. Gudzinskaitė for 2017 was assessed inappropriately. The court found that the Minister of the Interior failed to delineate tasks for E. Gudzinskaitė, to establish clear performance indicators, there was no career development discussion about her official activities, abilities and qualification. Likewise, the career development report drawn by the Minister of the Interior was not based on objective facts. The courts also declared that there was no conversation between the minister and E. Gudzinskaitė during which his professional activities, abilities and qualifications were to be discussed, and that the conclusion of the official jury written by E. Misiūnas is not based on objective data.
