COBALT invites to the seminar “Public Procurement: confidentiality, agreements and latest recommendations”, which will be given by Dr Deividas Soloveičik, Partner at COBALT and Head of the Public Procurement practice group.
The seminar programme has been developed on the basis of questions asked by experts. Confidentiality and contract amendments are further qualified as the topics frequently addressed by case law; however, procedural errors as well as major mistakes in the assessment of a situation still persist. Therefore, the seminar will aim at repeating the basic rules related to these aspects and at conveying the knowledge on how to avoid practical errors in public procurement procedures.
More detailed attention will be given to the regulated but less frequently addressed themes – termination of a public procurement agreement and ‘self-cleaning’ in public procurement. Although the regulation cannot be qualified as new topic, but the lack of practical applicability still places it among new ones. Therefore, this issue calls for deeper insight into such requirements and requires answers to the related questions. The seminar will also focus on the relevant case law developed by the Supreme Court of Lithuania. Over 40 public procurement related disputes were resolved by the Supreme Court of Lithuania in 2018. A record year! Thus, this practice needs a deeper scrutiny.

Confidentiality requirements in a procurement procedure: duties of contracting authorities and rights of participants;
Amending public procurement agreements: in-depth analysis of Art. 89 of the Law on Public Procurement;
Termination of a public procurement contract (Art. 90 of the Law on Public Procurement);
‘Self-cleaning’ (rehabilitation) as a condition to participate in public procurement again;
Review of relevant case law of the Supreme Court of Lithuania.
