Advokaadib\u00fcroo COBALT partner Liina Linsi annab \u00fclevaate olulisematest muudatustest.<\/p>\n<p class=\"Normaltextafter12\">Uue seaduse vastuv\u00f5tmise peaeesm\u00e4rgiks oli reguleerida k\u00f5ik korteriomandiga seotud \u00f5igussuhted \u00fches seaduses. Sisulise poole pealt on k\u00f5ige olulisemaks korteriomandite valitsemist puudutav muudatus ja nimelt see, et k\u00f5igi korteriomandite valitsemine hakkab toimuma l\u00e4bi korteri\u00fchistu.<\/p>\n<p class=\"Normaltextafter12\">Korteri\u00fchistu saab olema see, mis korteriomandite kaasomandi valitsemist korraldab. See t\u00e4hendab, et k\u00f5ik, mis ei ole korteriomandi omanike eriomand, j\u00e4\u00e4b kaasomandina korteri\u00fchistu valitseda. Juba olemasolevate korteriomandi omanike jaoks on oluline see, et kui seaduse j\u00f5ustumise hetkeks ei ole moodustatud korteri\u00fchistut, tekib seaduse j\u00f5ustumisel korteriomandite valitsemiseks korteri\u00fchistu ning senise korteriomanike \u00fchisuse \u00f5igused ja kohustused l\u00e4hevad sellele \u00fcle. Muudetud on ka juhatuse olemasolu n\u00f5uet. Kuni k\u00fcmne korteriomandiga majadel v\u00f5i kui k\u00f5ik korteriomandid kuuluvad \u00fchele isikule, ei ole juhatust vaja ning sellisel juhul esindavad omanikud \u00fchistut \u00fchiselt.<\/p>\n<p class=\"Normaltextafter12\"><strong>\u00dchistule tekib pandi\u00f5igus<\/strong><\/p>\n<p class=\"Normaltextafter12\">T\u00e4iesti uus on pandi\u00f5iguse regulatsioon. Selle eesm\u00e4rgiks on lihtsustada korteri\u00fchistu n\u00f5uete realiseerimist omanike vastu. Nimelt, kui korteriomandi omanik on j\u00e4\u00e4nud \u00fchistule v\u00f5lgu majandamiskulude eest, v\u00f5ib \u00fchistu n\u00fc\u00fcdsest arvestada sellega, et nimetatud kohustuste t\u00e4itmine on tagatud pandi\u00f5igusega ilma, et vastav \u00f5igus isegi registrist n\u00e4htuks. Kui korteriomand on koormatud ka h\u00fcpoteekidega, on \u00fchistul siiski v\u00f5imalik olenemata sellest oma n\u00f5ue maksma panna.<\/p>\n<p class=\"Normaltextafter12\">Arvestama peab \u00fcksnes sellega, et pandi\u00f5iguse suurus ei saa olla enam kui korteriomandi eelmise majandusaasta majandamiskulude summa. Nimetatud regulatsiooni kehtestades anal\u00fc\u00fcsiti, kas taoline pandi\u00f5igus v\u00f5iks hilisemalt saada takistuseks elamuasemelaenude saamisel pankadest, kuid anal\u00fc\u00fcsi tulemusena j\u00f5uti arvamusele, et kuiv\u00f5rd pandi\u00f5iguse suurus on selgelt piiritletud suurusega ning see kehtib k\u00f5ikide korteriomandite puhul, ei saa pandi\u00f5iguse m\u00f5ju olla oluline.<\/p>\n<p class=\"Normaltextafter12\"><strong>Lihtsam otsuseid vastu v\u00f5tta<\/strong><\/p>\n<p class=\"Normaltextafter12\">Muutub korteri\u00fchistu koosoleku otsustusv\u00f5imelisus. Praegu kehtib p\u00f5him\u00f5te, et korteri\u00fchistu liikmed saavad koosolekut kokku kutsumata otsuseid vastu v\u00f5tta vaid siis, kui k\u00f5ik \u00fchistu liikmed on vastava otsusega n\u00f5us. 1. jaanuarist tuleb aga arvestada sellega, et koosolekut kokku kutsumata tehtud otsused kehtivad ka siis, kui nende poolt on h\u00e4\u00e4letanud enam kui pool korteriomanikest. \u00dchtlasi muutub kord, kuidas kortermaja omanikud otsustavad ehituslike \u00fcmberkorralduste tegemist kaasomandi suhtes. Kui praegu on selleks vajalik k\u00f5igi omanike n\u00f5usolek, siis edaspidi piisab v\u00e4hemalt enam kui poolte korteriomandi omanike h\u00e4\u00e4ltest eeldusel, et neile kuulub enam kui pool kaasomandi suurusest.<\/p>\n<p class=\"Normaltextafter12\"><strong>\u00dchised laenud kantakse registrisse<\/strong><\/p>\n<p class=\"Normaltextafter12\">Korteri\u00fchistute tegevus muutub l\u00e4bipaistvamaks. \u00dchelt poolt saab olema k\u00f5igil \u00fchistu liikmetel \u00f5igus saada teavet \u00fchistu tegevuse kohta ja tutvuda kogu \u00fchistut puudutava dokumentatsiooniga, teiselt poolt muutuvad \u00fchistu v\u00f5etavad laenud korteri\u00fchistute registris n\u00e4htavaks. Nimelt on seadusega kehtestatud kohustus tavap\u00e4rast valitsemist \u00fcletava laenukoormuse korral kanda m\u00e4rkus laenu olemasolu kohta registrisse. Oluline on r\u00f5hutada, et regulatsioon ei puuduta \u00fcksnes laene, mis v\u00f5etakse peale 1. jaanuari 2018, vaid ka varasemaid laene. Need tuleb registrisse kanda hiljemalt 31. detsembriks 2018. Juhatuse liikmed peaksid arvestama sellega, et laenude registrisse kandmata j\u00e4tmise korral vastutavad nad isiklikult tekkida v\u00f5iva kahju eest.<\/p>\n<p class=\"Normaltextafter12\"><strong>K\u00fctet ei tohi enam v\u00e4lja l\u00fclitada<\/strong><\/p>\n<p class=\"Normaltextafter12\">\u00dcks p\u00e4ris oluline uuendus on, et igale omanikule on s\u00e4testatud selges\u00f5naline kohustus hoida oma korteris sellist temperatuuri ja \u00f5huniiskust, mis tagab kogu hoone s\u00e4ilitamise ja teiste korterite kasutamise otstarbekohaselt ning liigsete kulutusteta. Seega on v\u00f5imalik edaspidi korrale kutsuda korteriomanikku, kes kokkuhoiu huvides l\u00fclitab enda \u00e4raolekul korterist k\u00fctte v\u00e4lja.<\/p>\n<p class=\"Normaltextafter12\">Kas korteriomandeid on v\u00f5imalik ka l\u00f5petada?
