Kuigi t\u00f6\u00f6vaidluse v\u00f5ib kaasa tuua iga t\u00f6\u00f6lepingulise kohustuse rikkumine, siis k\u00f5ige sagedamini on t\u00f6\u00f6vaidlused seotud just t\u00f6\u00f6lepingu l\u00f5petamistega. Mis on olulisemad k\u00fcsimused, mida t\u00f6\u00f6vaidluse protsessis silmas pidada, l\u00e4bi m\u00f5elda ja arvestada?<\/p>\n<p><strong>T\u00f6\u00f6lepingu erakorraline \u00fcles\u00fctlemine<\/strong><\/p>\n<p>T\u00f6\u00f6lepingu rikkumise korral v\u00f5ib t\u00f6\u00f6lepingu erakorraliselt \u00fcles \u00f6elda nii t\u00f6\u00f6andja kui ka t\u00f6\u00f6taja, esitades selleks teisele poolele t\u00f6\u00f6lepingu \u00fcles\u00fctlemisavalduse. Avaldus peab sisaldama \u00fcles\u00fctlemise aluseks olevaid asjaolusid ja p\u00f5hjendusi. Tasub teada, et hiljem on neid vaidluse k\u00e4igus keeruline, kui mitte lubamatu, t\u00e4iendada. Seega p\u00f5hjalik \u00fcles\u00fctlemisavaldus on v\u00f5ti vaidluse ennetamiseks v\u00f5i edukaks osutumiseks.<\/p>\n<p>Kui aga emb-kumb t\u00f6\u00f6suhte pooltest avalduses toodud etteheidetega ei n\u00f5ustu, siis tuleb avaldusega mitte n\u00f5ustuval poolel \u00fcles\u00fctlemine vaidlustada 30 p\u00e4eva jooksul arvates \u00fcles\u00fctlemisavalduse saamisest.<\/p>\n<p>T\u00f6\u00f6andja poolt vaadatuna peab \u00fcles\u00fctlemisele reeglina eelnema hoiatus ehk t\u00f6\u00f6taja peab olema teadlik, et kui k\u00e4itumine ei muutu v\u00f5i etteheidetav tegu kordub, siis t\u00f6\u00f6suhe l\u00f5petatakse. Soovitavalt v\u00f5iks see hoiatus olla kirjalik v\u00f5i saadetud e-kirja teel, et hiljem oleks v\u00f5imalik t\u00f5endada hoiatuse tegemist. Eelnevat hoiatamist ei ole vaja \u00fcksnes juhul, kui tegemist on eriliselt raske rikkumisega. Millisel juhul on tegu eriliselt raske rikkumisega, on igakordse hindamise k\u00fcsimus ja tihtipeale t\u00f6\u00f6vaidlustes oluline vaidluskoht. Kui kohus v\u00f5i t\u00f6\u00f6vaidluskomisjon peaks leidma, et rikkumine ei olnud niiv\u00f5rd raske, et \u00f5igustaks t\u00f6\u00f6lepingu kohest l\u00f5petamist, toob see kaasa \u00fcles\u00fctlemise t\u00fchisuse ja t\u00f6\u00f6andjal tuleb tasuda h\u00fcvitist t\u00f6\u00f6taja kolme kuu keskmise t\u00f6\u00f6tasu ulatuses (teatud t\u00f6\u00f6tajate puhul 12 kuu t\u00f6\u00f6tasu ulatuses). Seejuures on kohtul kaalutlusruum h\u00fcvitise suuruse muutmiseks, mis t\u00e4hendab, et h\u00fcvitis v\u00f5ib osutuda ka suuremaks, kui asjaolud seda \u00f5igustavad. Seega soovitus \u2013 t\u00f6\u00f6tajapoolse rikkumise korral peab t\u00f6\u00f6andja p\u00f5hjalikult l\u00e4bi m\u00f5tlema, kas rikkumise n\u00e4ol on tegemist eriliselt raske rikkumisega v\u00f5i tuleb antud olukorras siiski piirduda hoiatusega. Kui on selge veendumus, et rikkumine on raske ja hoiatuse tegemine ei kanna eesm\u00e4rki, siis on vaidlusel edulootust; kui rikkumine on k\u00f5rvaldatav ja selle raskus k\u00fcsitav, siis on ka vaidluse perspektiiv pigem madal. Igal juhul tasub enne t\u00f6\u00f6lepingu l\u00f5petamist eelnev p\u00f5hjalikult l\u00e4bi m\u00f5elda, kuna perspektiivitusse vaidlusesse minek ei ole mitte \u00fcksnes majanduslikult kurnav, vaid v\u00f5ib m\u00f5ju omada ka t\u00f6\u00f6keskkonnale ja t\u00f6\u00f6andja mainele.<\/p>\n<p>T\u00f6\u00f6andjal on oluline silmas pidada, et kui t\u00f6\u00f6taja l\u00f5petab t\u00f6\u00f6suhte seoses t\u00f6\u00f6andjapoolse t\u00f6\u00f6lepingu rikkumisega, kuid t\u00f6\u00f6andja ei n\u00f5ustu sellega, siis tuleb t\u00f6\u00f6andjal \u00fcles\u00fctlemine vaidlustada. Kui t\u00f6\u00f6andja seda ei tee ega esita kohtusse v\u00f5i t\u00f6\u00f6vaidluskomisjoni \u00fcles\u00fctlemise t\u00fchisuse tuvastamise n\u00f5uet eeltoodud t\u00e4htaja jooksul, siis on t\u00f6\u00f6andjal kohustus maksta t\u00f6\u00f6tajale h\u00fcvitist t\u00f6\u00f6taja kolme kuu keskmise t\u00f6\u00f6tasu ulatuses. Kohtul v\u00f5i t\u00f6\u00f6vaidluskomisjonil on ka sel juhul \u00f5igus h\u00fcvitise suurust muuta.<\/p>\n<p><strong>T\u00f5endamine<\/strong><\/p>\n<p>Kas t\u00f6\u00f6suhte l\u00f5petamise etapis v\u00f5i siis juba t\u00f6\u00f6vaidluskomisjonis v\u00f5i kohtus olles tuleb l\u00e4bi m\u00f5elda, kuidas on v\u00f5imalik enda v\u00e4iteid t\u00f5endada. Nagu igas kohtuvaidluses, nii ka t\u00f6\u00f6vaidluses kehtib p\u00f5him\u00f5te, et enda v\u00e4iteid tuleb t\u00f5endada, pelgast selgitamisest ja asjaolude kirjeldamisest ei piisa, olgu need nii veenvad kui tahes. Seega t\u00f6\u00f6suhte osapool, kes rikkumist v\u00e4idab, peab seda ka t\u00f5endama. Kuigi seaduse kohaselt hinnatakse t\u00f5endeid kogumis ja \u00fchelgi t\u00f5endil ei ole kindlaks m\u00e4\u00e4ratud t\u00f5endamisj\u00f5udu, siis \u00fcldreeglina on k\u00f5ige efektiivsem kirjalik t\u00f5end (n\u00e4iteks e-kiri, suhtlusplatvormi v\u00e4ljav\u00f5te, kokkulepe). Sageli ei ole t\u00f6\u00f6suhetes aga kokkulepetest ja olukorrast kirjalikku j\u00e4lge, millisel juhul tuleks kaaluda tunnistaja \u00fclekuulamist v\u00f5i nendelt kirjalike selgituste v\u00f5tmist. Kui aga t\u00f5endeid ei ole ja seisukoht on kujunenud pigem subjektiivse veendumuse pinnalt, siis tasub t\u00f5siselt kaaluda v\u00f5imalust vaidlus kokkuleppel lahendada.<\/p>\n<p><strong>Kulud<\/strong><\/p>\n<p>Iga menetlusega kaasnevad kulud, mist\u00f5ttu tuleb silmas pidada, et isegi kui vaidlus osutub t\u00f6\u00f6vaidluskomisjonis edukaks, siis t\u00f6\u00f6vaidluskomisjoni menetlusega kaasnevad \u00f5igusabikulud ei kuulu h\u00fcvitamisele. See t\u00e4hendab, et kui t\u00f6\u00f6taja v\u00f5i t\u00f6\u00f6andja on otsustanud v\u00f5tta endale t\u00f6\u00f6vaidluskomisjoni menetluseks lepingulise esindaja, j\u00e4\u00e4vad kulud igal juhul poole enda kanda. K\u00fcll aga, kui vaidlus j\u00e4tkub kohtus, siis saab lisaks kohtumenetluses kantud \u00f5igusabikuludele n\u00f5uda ka t\u00f6\u00f6vaidluskomisjonis kantud \u00f5igusabikulude h\u00fcvitamist.<\/p>\n<p><strong>Menetluse kestus<\/strong><\/p>\n<p>Menetlus t\u00f6\u00f6vaidluskomisjonis on \u00fcldreeglina kiire ja avalduse esitamisest otsuseni kulub ligikaudu paar kuud. Seevastu kohtumenetluses tuleb s\u00f5ltuvalt vaidluse sisust arvestada paari aastaga, keerukamate juhtumite korral isegi enam.<\/p>\n<p><strong>Kompromiss<\/strong><\/p>\n<p>Kohtul ja t\u00f6\u00f6vaidluskomisjonil on seadusest tulenev kohustus suunata pooli asja lahendamisele kokkuleppel. Seet\u00f5ttu on tavap\u00e4rane, et istungil arutatakse asja kompromissiga lahendamise v\u00f5imalusi ja nii m\u00f5nigi kord v\u00f5ib kohus v\u00f5i t\u00f6\u00f6vaidluskomisjon v\u00e4lja k\u00e4ia enda n\u00e4gemuse kokkuleppest. Sellest ei tasu j\u00e4reldada asja \u00fche v\u00f5i teise poole kasuks lahendamist, tegu on tavap\u00e4rase protsessi osaga. Seega nii t\u00f6\u00f6andjal kui t\u00f6\u00f6tajal tasub juba vaidluse alguses kaaluda, kas oleks majanduslikult otstarbekas t\u00f6\u00f6t\u00fcli kokkuleppel lahendada.
