Kindlasti ei vasta muudatuste ulatus k\u00f5ikide\u00a0t\u00f6\u00f6andjate ootustele ja praktikas levinud t\u00f6\u00f6tamise viisidele, kuid algus on tehtud.<\/p>\n<p>1. jaanuaril 2023.\u00a0a j\u00f5ustuvate <strong>t\u00f6\u00f6tervishoiu ja t\u00f6\u00f6ohutuse seaduse<\/strong> muudatustega suurendatakse t\u00f6\u00f6tervishoiuarsti rolli ning tuuakse selgust kaugt\u00f6\u00f6ga seotud t\u00f6\u00f6andja ja t\u00f6\u00f6tajate kohustuste ning vastutuse osas.<\/p>\n<p>Tehnoloogiaettev\u00f5tetele peaks pakkuma huvi alates uuest aastast <strong>v\u00e4lismaalaste seadusesse<\/strong> toodud erand, mis v\u00f5imaldab neil lihtsustatud korras v\u00e4lismaalasi palgata.<\/p>\n<p>Seekordses uudiskirjas anname \u00fclevaate eesootavatest muudatustest ning lisaks Ukrainast tulnud inimeste t\u00f6\u00f6le v\u00f5tmisest.<\/p>\n<p>Uuel aasta j\u00f5ustuvate \u00a0muudatuste valguses tasub \u00fcle vaadata ja ajakohastada ettev\u00f5tte t\u00f6\u00f6lepingud ning ka v\u00f5la\u00f5iguslikud lepingud f\u00fc\u00fcsiliste isikutega. Tuletame meelde, et 1. augustil 2022.\u00a0a j\u00f5ustusid t\u00f6\u00f6lepingu seaduse muudatused, mis n\u00e4gid ette t\u00f6\u00f6lepingutele t\u00e4iendavad kohustuslikud tingimused. \u00dclevaadet nendest tingimustest saab lugeda: <a href=\"https:\/\/cobalt.smai.ly\/r?oid=12075&amp;mid=8JQlIK5rb&amp;lid=nopbec3n&amp;url=https:\/\/www.cobalt.legal\/ee\/uudised-ja-tehtud-tood\/taiendavad_toolepingu_kohustuslikud_tingimused&amp;s=d2d781eec1f1f83a57862bf0d29f309f82695c073a2c8f19470d19ca3a85124a\">https:\/\/www.cobalt.legal\/ee\/uudised-ja-tehtud-tood\/taiendavad_toolepingu_kohustuslikud_tingimused<\/a>.<\/p>\n<p>Uudiskirja koostasid Advokaadib\u00fcroo COBALT partner Karina Paatsi, vandeadvokaat Heili Haabu ja advokaat Johanna-Britt Mikk.<\/p>\n<p><strong>Iseseisva otsustusp\u00e4devusega t\u00f6\u00f6taja <\/strong><\/p>\n<p>Kehtiv t\u00f6\u00f6lepingu seadus eeldab, et t\u00f6\u00f6taja t\u00e4idab t\u00f6\u00f6\u00fclesandeid ettev\u00f5tte tavap\u00e4rasel t\u00f6\u00f6ajal, kui ei ole kokku lepitud teisiti. T\u00f6\u00f6taja t\u00f6\u00f6aeg peab olema toodud t\u00f6\u00f6lepingus. Siiski on tekkimas aina enam t\u00f6\u00f6kohti, mille puhul ei ole t\u00f6\u00f6 iseloomust l\u00e4htuvalt t\u00f6\u00f6 tegemine kindlatel kellaaegadel oluline, ning t\u00f6\u00f6tajaid, kes soovivad vabadust korraldada oma t\u00f6\u00f6aega vastavalt enda soovidele ning vajadustele. Eeltoodut arvestades on igati tervitatav 24. detsembril 2022. a j\u00f5ustuv t\u00f6\u00f6aja korralduse regulatsioon, mis toob (taas) t\u00f6\u00f6lepingu seadusesse iseseisva otsustusp\u00e4devusega t\u00f6\u00f6taja m\u00f5iste. Tegemist on t\u00f6\u00f6tajaga, kes on t\u00f6\u00f6 iseloomust l\u00e4htuvalt vaba oma t\u00f6\u00f6aega ise korraldama ning kellega saab leppida kokku erisustes tavap\u00e4rastest t\u00f6\u00f6- ja puhkeaja normidest.\u00a0<a href=\"https:\/\/www.cobalt.legal\/ee\/uudised-ja-tehtud-tood\/iseseisva_otsustuspadevusega_tootaja\/&amp;type=all\">Loe edasi<\/a><\/p>\n<p><strong>Paindlikum valveaeg info- ja kommunikatsioonitehnoloogia t\u00f6\u00f6tajatele<\/strong><\/p>\n<p>Valveaeg on potentsiaalne t\u00f6\u00f6aeg, mist\u00f5ttu peab t\u00f6\u00f6andja tagama t\u00f6\u00f6tajatele valveaja planeerimisel ja rakendamisel igap\u00e4evase ja igan\u00e4dalase puhkeaja kasutamise v\u00f5imaluse. See t\u00e4hendab, et t\u00e4ist\u00f6\u00f6ajaga t\u00f6\u00f6tavale t\u00f6\u00f6tajale, kes t\u00f6\u00f6tab 8 tundi p\u00e4evas (lisaks t\u00f6\u00f6p\u00e4evasisene vaheaeg 0,5 tundi), saab kokkuleppel rakendada valveaega 4,5 tundi p\u00e4evas. Praktikas on vajadus rakendada info- ja kommunikatsioonitehnoloogia (IKT) teenustega tegelevaid t\u00f6\u00f6tajaid valveajale lubatust pikema aja jooksul, et tagada infos\u00fcsteemidega seotud probleemide kiire lahendamine ning j\u00e4rjepidev teenuste toimimine. Seet\u00f5ttu on seadusandja loonud kitsalt IKT-teenustega tegelevatele t\u00f6\u00f6tajatele valveaja \u00fcldregulatsioonist erandi, mis v\u00f5imaldab poolte kokkuleppel kalduda k\u00f5rvale igap\u00e4evasest ja igan\u00e4dalasest puhkeaja n\u00f5uetest.\u00a0<a href=\"https:\/\/www.cobalt.legal\/ee\/uudised-ja-tehtud-tood\/paindlikum_valveaeg_info-_ja_kommunikatsioonitehnoloogia_tootajatele\/&amp;type=all\">Loe edasi<\/a><\/p>\n<p><strong>Erisused j\u00e4rjestikuste t\u00e4htajaliste t\u00f6\u00f6lepingute s\u00f5lmimiseks t\u00f6\u00f6tuna arvel olevate inimestega<\/strong><\/p>\n<p>T\u00f6\u00f6tuna registreeritutel on alates 2020. aasta septembrist lubatud teha p\u00f5hit\u00f6\u00f6 otsimise k\u00f5rvalt t\u00f6\u00f6ampse ehk l\u00fchiajalist t\u00f6\u00f6d, ilma, et see nende t\u00f6\u00f6tuna arvelolekut l\u00f5petaks. Kehtiv seadus v\u00f5imaldab s\u00f5lmida t\u00f6\u00f6tajaga t\u00e4htajalise t\u00f6\u00f6lepingu samalaadse t\u00f6\u00f6 tegemiseks j\u00e4rjestikku \u00fcksnes kahel korral ning pikendada t\u00e4htajalist lepingut korra viie aasta jooksul, ilma, et leping muutuks t\u00e4htajatuks. Kuiv\u00f5rd praegu ei saa t\u00f6\u00f6taja sama t\u00f6\u00f6andja juures t\u00f6\u00f6lepingu alusel mitmeid kordi t\u00f6\u00f6ampse tegemas k\u00e4ia, on praktikas hakatud t\u00f6\u00f6ampsudeks kasutama t\u00f6\u00f6lepingute asemel t\u00f6\u00f6v\u00f5tu- ja k\u00e4sunduslepinguid, mille s\u00f5lmimisel j\u00e4\u00e4b t\u00f6\u00f6taja aga ilma t\u00f6\u00f6\u00f5iguslikust kaitsest. Parema kaitse tagamise eesm\u00e4rgil on seadusandja teinud t\u00f6\u00f6tuna arvel olevate inimestega t\u00e4htajaliste t\u00f6\u00f6lepingute j\u00e4rjestikuseks s\u00f5lmimiseks n\u00fc\u00fcd erisuse.\u00a0<a href=\"https:\/\/www.cobalt.legal\/ee\/uudised-ja-tehtud-tood\/erisused_jarjestikuste_tahtajaliste_toolepingute_solmimiseks_tootuna_arvel_olevate_inimestega\/&amp;type=all\">Loe edasi<\/a><\/p>\n<p><strong>Ehitust\u00f6\u00f6 tellija vastutus allt\u00f6\u00f6v\u00f5tja poolt t\u00f6\u00f6tajatele maksmata t\u00f6\u00f6tasu eest<\/strong><\/p>\n<p>15. oktoobril 2022.\u00a0a j\u00f5ustunud t\u00f6\u00f6lepingu seaduse muudatused s\u00e4testavad esmakordselt ehitusvaldkonnas allt\u00f6\u00f6v\u00f5tu tellinud isiku vastutuse allt\u00f6\u00f6v\u00f5tja poolt t\u00f6\u00f6tajatele t\u00f6\u00f6tasu maksmise kohustuse eest. See t\u00e4hendab, et allt\u00f6\u00f6v\u00f5tu raames ehitust\u00f6id tegevad t\u00f6\u00f6tajad saavad n\u00f5uda seaduses s\u00e4testatud tingimustel saamata j\u00e4\u00e4nud t\u00f6\u00f6tasu mitte ainult oma t\u00f6\u00f6andjalt, vaid ka allt\u00f6\u00f6v\u00f5tu tellinud isikult &#8211; k\u00fcll aga \u00fcksnes piiratud ulatuses.\u00a0<a href=\"https:\/\/www.cobalt.legal\/ee\/uudised-ja-tehtud-tood\/ehitustoo_tellija_vastutus_alltoovotja_poolt_tootajatele_maksmata_tootasu_eest\/&amp;type=all\">Loe edasi<\/a><\/p>\n<p><strong>Muudatused t\u00f6\u00f6tervishoiu ja t\u00f6\u00f6ohutuse korralduses<\/strong><\/p>\n<p>Saabuv aasta toob kaasa muudatusi t\u00f6\u00f6taja t\u00f6\u00f6tervishoiu korralduses. Alates 1. jaanuarist 2023. a. taastub koroonameetmete-eelne haigush\u00fcvitise maksmise kord, mille kohaselt t\u00f6\u00f6taja esimese kolme haigusp\u00e4eva eest h\u00fcvitist ei saa ning \u00f5igus h\u00fcvitisele tekib alates neljandast haigusp\u00e4evast. Edaspidi tuleb varasemast enam kaasata ettev\u00f5tte t\u00f6\u00f6tervishoiu korraldusse t\u00f6\u00f6tervishoiuarst, kelle roll suureneb oluliselt. Lisaks on toodud rohkem selgust kaugt\u00f6\u00f6ga seotud t\u00f6\u00f6tervishoiu korralduse osas.\u00a0<a href=\"https:\/\/www.cobalt.legal\/ee\/uudised-ja-tehtud-tood\/muudatused_tootervishoiu_ja_tooohutuse_korralduses\/&amp;type=all\">Loe edasi<\/a><\/p>\n<p><strong>V\u00e4lismaalaste palkamine<\/strong><\/p>\n<p>Novembri l\u00f5pus kinnitas Vabariigi Valitsus 2023. a sisser\u00e4nde piiarvu ning Politsei- ja Piirivalveamet lisas sellele tuginedes oma broneerimiss\u00fcsteemi ajad detsembris ja jaanuaris elamisloataotluste esitamiseks. K\u00f5ik ajad said broneeritud \u00fcksnes loetud minutitega ning broneerimiskalendri avanemist oodanud v\u00e4lismaalased j\u00e4id sageli broneeringust ilma. Seega on elamislubade taotlemine kolmandate riikide kodanikest t\u00f6\u00f6tajatele tavakorras muutumas praktikas \u00fcha keerulisemaks ja sarnaneb pigem loteriiga.
