T\u00f6\u00f6taja t\u00f6\u00f6aeg peab olema toodud t\u00f6\u00f6lepingus. Siiski on tekkimas aina enam t\u00f6\u00f6kohti, mille puhul ei ole t\u00f6\u00f6 iseloomust l\u00e4htuvalt t\u00f6\u00f6 tegemine kindlatel kellaaegadel oluline, ning t\u00f6\u00f6tajaid, kes soovivad vabadust korraldada oma t\u00f6\u00f6aega vastavalt enda soovidele ning vajadustele. Eeltoodut arvestades on igati tervitatav 24. detsembril 2022. a j\u00f5ustuv t\u00f6\u00f6aja korralduse regulatsioon, mis toob (taas) t\u00f6\u00f6lepingu seadusesse iseseisva otsustusp\u00e4devusega t\u00f6\u00f6taja m\u00f5iste. Tegemist on t\u00f6\u00f6tajaga, kes on t\u00f6\u00f6 iseloomust l\u00e4htuvalt vaba oma t\u00f6\u00f6aega ise korraldama ning kellega saab leppida kokku erisustes tavap\u00e4rastest t\u00f6\u00f6- ja puhkeaja normidest.<\/p>\n<p>Iseseisva otsustusp\u00e4devusega t\u00f6\u00f6taja saab vastavalt enda soovidele ja vajadustele otsustada, millal, sealhulgas mis p\u00e4eval ja kellaajal, ning kui palju ta t\u00f6\u00f6d teeb. Seda, kas t\u00f6\u00f6taja on vaba oma t\u00f6\u00f6aega ise planeerima, tuleb iga t\u00f6\u00f6taja puhul eraldi hinnata. Selline iseseisvus v\u00f5ib olla n\u00e4iteks t\u00f5lkidel, raamatupidajatel, juristidel v\u00f5i teatud k\u00f5rgastme juhtidel.<\/p>\n<p>T\u00f6\u00f6andja saab iseseisva otsustusp\u00e4devusega t\u00f6\u00f6tajaga kokku leppida, et t\u00f6\u00f6tajale ei kohaldu:<\/p>\n<ul>\n<li>t\u00f6\u00f6aja korralduse regulatsioon;<\/li>\n<li>\u00f6\u00f6sel ja riigip\u00fchal tehtava t\u00f6\u00f6 h\u00fcvitamise kord;<\/li>\n<li>valveaja regulatsioon;<\/li>\n<li>\u00f6\u00f6t\u00f6\u00f6 piirang;<\/li>\n<li>igap\u00e4evase ja igan\u00e4dalase puhkeaja piirangud, ning<\/li>\n<li>t\u00f6\u00f6aja l\u00fchendamise kord.<\/li>\n<\/ul>\n<p>Kokkulepe peab olema kirjalik ning selle s\u00f5lmimine eeldab, et t\u00f6\u00f6taja on t\u00e4iel m\u00e4\u00e4ral vaba oma t\u00f6\u00f6aega planeerima. Erandit ei saa kohaldada t\u00f6\u00f6tajate suhtes, kes v\u00f5ivad t\u00f6\u00f6aega ise m\u00e4\u00e4rata \u00fcksnes osaliselt (n\u00e4iteks suur osa \u00fclesannetest tuleb t\u00e4ita kindlatel kellaaegadel). Vaatamata paindlikule t\u00f6\u00f6aja korraldusele, allub iseseisva otsustusp\u00e4devusega t\u00f6\u00f6taja siiski t\u00f6\u00f6andja juhtimisele ja kontrollile. Seega saavad t\u00f6\u00f6taja ja t\u00f6\u00f6andja kokku leppida t\u00f6\u00f6taja osalemises teatud koosolekutel v\u00f5i kohtumistel ning t\u00f6\u00f6\u00fclesannete t\u00e4htaegades.<\/p>\n<p>Iseseisva otsustusp\u00e4devusega t\u00f6\u00f6taja peab tegema t\u00f6\u00f6d vastavalt kokkulepitud t\u00f6\u00f6mahule. See t\u00e4hendab, et t\u00f6\u00f6taja t\u00f6\u00f6tundide arv \u00fches kalendrikuus s\u00f5ltub t\u00f6\u00f6lepingus kokku lepitud t\u00f6\u00f6koormusest ja kalendaarsete t\u00f6\u00f6p\u00e4evade arvust. T\u00f6\u00f6aja arvestamisele kohaldatakse \u00fchekuulist arvestusperioodi. Kui jooksva kuu t\u00f6\u00f6tunnid hakkavad t\u00e4ituma ning v\u00f5ib esineda vajadus teha \u00fcletunnit\u00f6\u00f6d, tuleb t\u00f6\u00f6tajal sellest t\u00f6\u00f6andjale teada anda. Vajadusel saavad pooled s\u00f5lmida \u00fcletunnit\u00f6\u00f6 tegemise kokkuleppe. \u00a0Samuti rakendub iseseisva otsustusp\u00e4devusega t\u00f6\u00f6taja suhtes \u00fcldine t\u00f6\u00f6 tegemise aja piirang. Seega \u00a0ei v\u00f5i t\u00f6\u00f6taja reeglina koos \u00fcletunnit\u00f6\u00f6ga t\u00f6\u00f6tada rohkem kui keskmiselt 48 tundi seitsmep\u00e4evase ajavahemiku kohta \u00fchekuulise arvestusperioodi jooksul.<\/p>\n<p>T\u00f6\u00f6andjal on kohustus pidada ka iseseisva otsustusp\u00e4devusega t\u00f6\u00f6taja t\u00f6\u00f6aja arvestust. Seet\u00f5ttu peaksid pooled kokku leppima, kuidas arvestust peetakse, sealhulgas kuidas ja millal peab t\u00f6\u00f6taja esitama t\u00f6\u00f6andjale andmed t\u00f6\u00f6tatud tundide kohta.<\/p>\n<p>Kokkuleppe s\u00f5lmimine on lubatud \u00fcksnes sellise iseseisva otsustusp\u00e4devusega t\u00f6\u00f6tajaga, kelle t\u00f6\u00f6tasu \u00fches kuus on v\u00e4hemalt Eesti keskmine brutokuupalk kokkuleppe s\u00f5lmimisele eelnenud kvartalis Statistikaameti avaldatud andmete alusel (2022. a III kvartalis 1\u00a0679 eurot). Hilisemaid muudatusi keskmises brutopalgas pooled arvestama ega j\u00e4lgima ei pea. Kokkulepet ei ole lubatud s\u00f5lmida alaealisega \u2013 sellisel juhul on kokkulepe t\u00fchine. Samuti ei tohi kokkulepe kahjustada t\u00f6\u00f6taja tervist ega ohutust.<\/p>\n<p>T\u00f6\u00f6taja ja t\u00f6\u00f6andja v\u00f5ivad kokkuleppe igal ajal \u00fcles \u00f6elda, teatades sellest teisele poolele 14 kalendrip\u00e4eva ette.
