Kehtiv seadus v\u00f5imaldab s\u00f5lmida t\u00f6\u00f6tajaga t\u00e4htajalise t\u00f6\u00f6lepingu samalaadse t\u00f6\u00f6 tegemiseks j\u00e4rjestikku \u00fcksnes kahel korral ning pikendada t\u00e4htajalist lepingut korra viie aasta jooksul, ilma, et leping muutuks t\u00e4htajatuks. Kuiv\u00f5rd praegu ei saa t\u00f6\u00f6taja sama t\u00f6\u00f6andja juures t\u00f6\u00f6lepingu alusel mitmeid kordi t\u00f6\u00f6ampse tegemas k\u00e4ia, on praktikas hakatud t\u00f6\u00f6ampsudeks kasutama t\u00f6\u00f6lepingute asemel t\u00f6\u00f6v\u00f5tu- ja k\u00e4sunduslepinguid, mille s\u00f5lmimisel j\u00e4\u00e4b t\u00f6\u00f6taja aga ilma t\u00f6\u00f6\u00f5iguslikust kaitsest. Parema kaitse tagamise eesm\u00e4rgil on seadusandja teinud t\u00f6\u00f6tuna arvel olevate inimestega t\u00e4htajaliste t\u00f6\u00f6lepingute j\u00e4rjestikuseks s\u00f5lmimiseks n\u00fc\u00fcd erisuse.<\/p>\n<p>Uue regulatsiooni kohaselt v\u00f5ib t\u00f6\u00f6tuna arveloleku ajal s\u00f5lmida t\u00e4htajalisi t\u00f6\u00f6lepinguid kestusega kuni kaheksa kalendrip\u00e4eva kuue kuu jooksul piiramatult. See t\u00e4hendab, et sellised kuue kuu jooksul s\u00f5lmitud t\u00f6\u00f6lepingud ei muutu t\u00e4htajatuks. Kuuekuulist perioodi hakatakse arvestama esimesest kuni kaheksa kalendrip\u00e4eva pikkuse t\u00e4htajalise t\u00f6\u00f6lepingu s\u00f5lmimise kuup\u00e4evast. Kui sama t\u00f6\u00f6taja ja t\u00f6\u00f6andja s\u00f5lmivad p\u00e4rast nimetatud perioodi l\u00f5ppu j\u00e4rgneva kuue kuu jooksul uue t\u00e4htajalise t\u00f6\u00f6lepingu, loetakse vastav t\u00f6\u00f6leping t\u00e4htajatuks.<\/p>\n<p>Nii nagu ka k\u00f5igi teiste t\u00e4htajaliste t\u00f6\u00f6lepingute puhul, \u00f5igustavad t\u00f6\u00f6ampsu tegemiseks t\u00e4htajalise lepingu s\u00f5lmimist \u00fcksnes t\u00f6\u00f6 ajutisest t\u00e4htajalisest iseloomust tulenevad m\u00f5juvad p\u00f5hjused. Sellisteks p\u00f5hjusteks v\u00f5ivad olla eelk\u00f5ige t\u00f6\u00f6mahu ajutine suurenemine v\u00f5i hooajat\u00f6\u00f6 tegemine.<\/p>\n<p>T\u00f6\u00f6andja peab veenduma, et t\u00f6\u00f6tajale kohaldub t\u00f6\u00f6ampsude tegija erisus. Selleks peab t\u00f6\u00f6taja t\u00f6\u00f6andjale avaldama ja kinnitama t\u00f6\u00f6tuna arvelolekut. Hilisemate vaidluste ja arusaamatuste v\u00e4ltimiseks on soovitatav k\u00fcsida t\u00f6\u00f6tajalt vastav kinnitus kirjalikult. Lisaks on soovitatav paluda t\u00f6\u00f6tajal esitada t\u00f6\u00f6tukassa v\u00e4ljastatud t\u00f5end t\u00f6\u00f6tuna arveloleku kohta.<\/p>\n<p>Samuti tuleb arvestada t\u00f6\u00f6turuteenuste ja -toetuste seadusest tulenevate piirangutega. Piirangute kohaselt v\u00f5ib registreeritud t\u00f6\u00f6tu t\u00f6\u00f6tada ajutiselt kuni kaheksa p\u00e4eva kalendrikuus ning k\u00f5ige rohkem 12 kalendrikuul 24-kuulise ajavahemiku jooksul. 24-kuulise ajavahemikuna arvestatakse igale ajutisele t\u00f6\u00f6tamisele eelnevat 24\u00a0kalendrikuud. Kui registreeritud t\u00f6\u00f6tu ajutise t\u00f6\u00f6tamise aeg \u00fcletab eelnimetatud piiranguid, l\u00f5petab t\u00f6\u00f6tukassa isiku t\u00f6\u00f6tuna arveloleku. T\u00f6\u00f6andjal tuleb eeltoodut silmas pidada, kuna t\u00f6\u00f6tukassa v\u00f5ib isiku t\u00f6\u00f6tuna arveloleku l\u00f5petada piirangute rikkumisest teadasaamisel ka tagasiulatuvalt.
