K\u00f5ik ajad said broneeritud \u00fcksnes loetud minutitega ning broneerimiskalendri avanemist oodanud v\u00e4lismaalased j\u00e4id sageli broneeringust ilma. Seega on elamislubade taotlemine kolmandate riikide kodanikest t\u00f6\u00f6tajatele tavakorras muutumas praktikas \u00fcha keerulisemaks ja sarnaneb pigem loteriiga. K\u00fcll aga on v\u00e4lismaalaste seadust viimasel ajal t\u00e4iendatud regulatsioonidega, mis v\u00f5imaldavad teatud kategooriate t\u00f6\u00f6tajate puhul l\u00e4bida vajalikud immigratsiooniformaalsused lihtsustatud korras.<\/p>\n<p><em><u>Kasvuettev\u00f5tete t\u00f6\u00f6tajad<\/u><\/em><\/p>\n<p>Alates 1. jaanuarist 2023. a j\u00f5ustub v\u00e4lismaalaste seaduse uus regulatsioon, mille kohaselt saavad sisser\u00e4nde piirarvu arvestamata Eestis elamisluba taotleda kasvuettev\u00f5tete t\u00f6\u00f6tajad. Kasvuettev\u00f5te v\u00e4lismaalaste seaduse t\u00e4henduses on tegevust kasvatav Eestis registreeritud \u00e4ri\u00fching, mille eesm\u00e4rk on suure globaalse kasvupotentsiaaliga, tehnoloogial p\u00f5hineva, innovaatilise ja korratava \u00e4rimudeli edasiarendamine, mis aitab oluliselt kaasa Eesti ettev\u00f5tluskeskkonna arengule ning mis vastab j\u00e4rgmistele tingimustele:<\/p>\n<ol>\n<li>\u00fching on tegutsenud v\u00e4hemalt k\u00fcmme aastat;<\/li>\n<li>Eestis t\u00f6\u00f6tab v\u00e4hemalt 50 t\u00f6\u00f6tajat;<\/li>\n<li>\u00fching on maksnud Eestis viimasel aastal t\u00f6\u00f6j\u00f5umakse v\u00e4hemalt \u00fcks miljon eurot ja<\/li>\n<li>t\u00f6\u00f6j\u00f5umaksude kumulatiivne kasv viimase kolme aasta jooksul on 20%.<\/li>\n<\/ol>\n<p>Sisuliselt on tegu t\u00e4iendusega senistele start-up\u2019ide erandile, mis v\u00f5imaldab lihtsustatud korras v\u00e4lismaalasi palgata pikemalt tegutsenud tehnoloogiaettev\u00f5tetel. Kasvuettev\u00f5tete v\u00e4lismaalastest t\u00f6\u00f6tajatele kehtib ka tavap\u00e4rasest v\u00e4iksem minimaalse t\u00f6\u00f6tasu n\u00f5ue &#8211; 80% Eesti keskmisest t\u00f6\u00f6tasust. Samuti ei ole nende t\u00f6\u00f6tajate puhul elamisloa taotlemise eeldusena vaja saada t\u00f6\u00f6tukassa n\u00f5usolekut vastava ametikoha t\u00e4itmiseks v\u00e4lismaalasega.<\/p>\n<p><em><u>T\u00e4htajaline elamisluba l\u00fchiajaliseks t\u00f6\u00f6tamiseks<\/u><\/em><\/p>\n<p>Teise erandina vabastatakse alates 1. jaanuarist 2023. a sisser\u00e4nde piirarvu alt v\u00e4lismaalased, kellele antakse t\u00e4htajaline elamisluba l\u00fchiajaliseks t\u00f6\u00f6tamiseks. Tegu on uue elamisloa kategooriaga, mis v\u00e4ljastatakse kuni kaheks aastaks v\u00e4lismaalasele, kui:<\/p>\n<ol>\n<li>v\u00e4lismaalane on vahetult enne elamisloa taotlemist t\u00f6\u00f6tanud Eestis l\u00fchiajalise t\u00f6\u00f6tamise registreerimise alusel v\u00e4hemalt \u00fcheksa kuud;<\/li>\n<li>t\u00f6\u00f6tamine j\u00e4tkub sama t\u00f6\u00f6andja juures;<\/li>\n<li>t\u00f6\u00f6andja on usaldusv\u00e4\u00e4rne;<\/li>\n<li>t\u00f6\u00f6andja on maksnud v\u00e4lismaalasele registreeritud l\u00fchiajalise t\u00f6\u00f6tamise perioodi jooksul n\u00f5uetele vastavat t\u00f6\u00f6tasu, see t\u00e4hendab v\u00e4hemalt Eesti keskmise t\u00f6\u00f6tasu suurust t\u00f6\u00f6tasu.<\/li>\n<\/ol>\n<p>Eelk\u00f5ige on regulatsioon suunatud seega t\u00f6\u00f6tajatele, kelle pikaajaline viisa ja \u00f5igus t\u00f6\u00f6tada Eestis l\u00fchiajalise t\u00f6\u00f6tamise registreeringu alusel on l\u00f5ppemas, kuid kes soovivad Eestis t\u00f6\u00f6tamist ajutiselt j\u00e4tkata. Antud elamisluba ei sobi p\u00fcsivaks Eestisse elama asumiseks, sest selle l\u00f5ppedes ei ole t\u00f6\u00f6tajal v\u00f5imalik sama t\u00fc\u00fcpi elamisluba \u00fche aasta jooksul uuesti saada ega olemasolevat elamisluba pikendada, samuti ei ole sellise elamisloa omaniku v\u00e4lismaalasest abikaasal reeglina v\u00f5imalik saada elamisluba Eestis viibiva abikaasa juurde elama asumiseks (erandiks on Ukraina kodanikud). Samas on tegu praktilise (ehkki ajutise) lahendusega nende t\u00f6\u00f6tajate jaoks, kes sisser\u00e4nde piirarvu alla ei mahu, kuid soovivad Eestis t\u00f6\u00f6tamist j\u00e4tkata.<\/p>\n<p><em><u>Ukraina t\u00f6\u00f6tajad<\/u><\/em><\/p>\n<p>Ukrainlastega seoses on meedias palju juttu olnud ajutise kaitse taotlemise v\u00f5imalusest ning \u00f5igusest p\u00e4rast kaitse saamist Eestis t\u00f6\u00f6le asuda. V\u00e4hem on t\u00f6\u00f6andjad kursis v\u00f5imalusega v\u00f5tta lihtsustatud korras t\u00f6\u00f6le ka neid ukrainlasi, kes on saabunud Eestisse enne 24. veebruarit 2022.\u00a0a ja kellel seet\u00f5ttu puudub \u00f5igus ajutisele kaitsele v\u00f5i kes pole ajutist kaitset muul p\u00f5hjusel taotlenud. Selliste isikute t\u00f6\u00f6lev\u00f5tmiseks on v\u00e4lismaalaste seadusega kehtestatud alates 24. maist 2022.\u00a0a erand, mis lubab neid t\u00f6\u00f6le v\u00f5tta\u00a0 tingimusel, et t\u00f6\u00f6andja maksab neile tasu, mille suurus on v\u00e4hemalt v\u00f5rdne Statistikaameti viimati avaldatud selle tegevusala, kus t\u00f6\u00f6le asutakse, Eesti aasta keskmise brutokuupalga ja koefitsiendi 0,8 korrutisega.
