Paindliku t\u00f6\u00f6aja kokkulepe on praktiline abin\u00f5u juhtudeks, kus t\u00f6\u00f6maht ja seet\u00f5ttu ka t\u00f6\u00f6j\u00f5uvajadus regulaarselt k\u00f5iguvad. Uue regulatsiooni n\u00e4ol on tegemist edasiarendusega varasemalt kehtinud muutuvtunni kokkulepete katseprojektist jaekaubanduses. N\u00fc\u00fcd on v\u00f5imalik kokkuleppeid s\u00f5lmida k\u00f5igis tegevusvaldkondades.<\/p>\n<h4><span style=\"color: #9fffec;\">Mis on paindliku t\u00f6\u00f6aja kokkulepe?<\/span><\/h4>\n<p>Paindliku t\u00f6\u00f6aja kokkulepe on t\u00f6\u00f6andja ja t\u00f6\u00f6taja vaheline kokkulepe, mille kohaselt t\u00f6\u00f6taja t\u00f6\u00f6aeg jaguneb kokkulepitud t\u00f6\u00f6tundideks ja lisatundideks. See v\u00f5imaldab pooltele t\u00f6\u00f6aja kokkuleppimisel paindlikkust \u2013 t\u00f6\u00f6andjal on kohustus tagada t\u00f6\u00f6tajale \u00fcksnes kokkulepitud t\u00f6\u00f6tunnid, kuid t\u00f6\u00f6tajal on v\u00f5imalik teha lisaks kokkulepitud t\u00f6\u00f6tundidele soovi korral t\u00f6\u00f6andja pakutavaid lisatunde. Sellised lisatunnid ei ole k\u00e4sitletavad \u00fcletundidena.<\/p>\n<p>Kokkulepitud t\u00f6\u00f6tunnid ja lisatunnid kokku ei tohi \u00fcletada t\u00e4ist\u00f6\u00f6aega. Pooled v\u00f5ivad n\u00e4iteks kokku leppida, et t\u00f6\u00f6taja t\u00f6\u00f6tab osalise t\u00f6\u00f6ajaga 30 tundi n\u00e4dalas (kokkulepitud t\u00f6\u00f6tunnid) ning v\u00f5ib teha lisatunde 10 tundi n\u00e4dalas, ilma et need oleksid k\u00e4sitletavad \u00fcletunnit\u00f6\u00f6na. Samuti v\u00f5ivad pooled kokku leppida, et t\u00f6\u00f6taja t\u00f6\u00f6tab 10\u201340 tundi n\u00e4dalas. Sellisel juhul kohustub t\u00f6\u00f6andja tagama t\u00f6\u00f6tajale t\u00f6\u00f6d 10 tunni ulatuses ning v\u00f5ib pakkuda t\u00f6\u00f6d 30 lisatunni ulatuses. Samuti on t\u00f6\u00f6tajal \u00f5igus lisatundide tegemisest keelduda.<\/p>\n<p>Kui t\u00f6\u00f6taja t\u00f6\u00f6tab \u00fcle kokkulepitud t\u00f6\u00f6tundide ja lisatundide, on tegemist \u00fcletundidega ja need tuleb vastavalt h\u00fcvitada.<\/p>\n<h4><span style=\"color: #9fffec;\">Millise t\u00f6\u00f6tajaga saab paindliku t\u00f6\u00f6aja kokkuleppe s\u00f5lmida?<\/span><\/h4>\n<p>Paindliku t\u00f6\u00f6aja kokkuleppe saab s\u00f5lmida t\u00f6\u00f6tajaga, kelle:<\/p>\n<ul>\n<li>tunnitasu on v\u00e4hemalt 1,2-kordne tunnitasu alamm\u00e4\u00e4r ja<\/li>\n<li>kokkulepitud t\u00f6\u00f6tunnid on v\u00e4hemalt 10 tundi seitsmep\u00e4evase ajavahemiku jooksul.<\/li>\n<\/ul>\n<h4><span style=\"color: #9fffec;\">Kuidas tuleb kokkulepe fikseerida?<\/span><\/h4>\n<p>Paindliku t\u00f6\u00f6aja kokkulepe tuleb s\u00f5lmida kirjalikus vormis ning peab sisaldama j\u00e4rgmisi tingimusi:<\/p>\n<ul>\n<li>kokkulepitud t\u00f6\u00f6tundide arv;<\/li>\n<li>lisatundide arv;<\/li>\n<li>minimaalne lisatundidest etteteatamise aeg;<\/li>\n<li>t\u00f6\u00f6taja \u00f5igus lisatundide tegemisest keelduda. Lisatundidega n\u00f5ustumist kinnitab t\u00f6\u00f6taja eelnevalt iga kord kirjalikku taasesitamist v\u00f5imaldavas vormis.<\/li>\n<\/ul>\n<h4><span style=\"color: #9fffec;\">Mida tasub veel arvesse v\u00f5tta?<\/span><\/h4>\n<p>T\u00f6\u00f6andjal on oluline veel teada, et kui t\u00f6\u00f6taja on t\u00f6\u00f6tanud viimase kuue kuu jooksul enamuse ajast rohkem kui kokkulepitud t\u00f6\u00f6tunnid, on t\u00f6\u00f6tajal \u00f5igus n\u00f5uda kokkulepitud t\u00f6\u00f6tundide suurendamist.
