Informuojama supa\u017eindinant su \u012fsakymu pasira\u0161ytinai ar elektroniniu b\u016bdu.<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>4.\u00a0<\/strong><strong>Ar paskelbus prastov\u0105 reikia keisti darbuotojo darbo sutart\u012f?<\/strong><\/p>\n<p style=\"text-align: justify;\">Ne.<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>5.\u00a0<\/strong><strong>Kaip supa\u017eindinti darbuotojus su priimamais \u012fsakymais ar kitais sprendimais karantino metu?<\/strong><\/p>\n<p style=\"text-align: justify;\">Darbuotojui pasira\u0161ant elektroniniu para\u0161u, arba, jei tokios galimyb\u0117s n\u0117ra, rekomenduotina pateikti dokumentus elektroniniu pa\u0161tu ir darbuotojui atsi\u0173sti patvirtinim\u0105, jog susipa\u017eino su dokumentais.<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>6.\u00a0<\/strong><strong>Ar gali b\u016bti taikomos skirtingos prastovos s\u0105lygos skirtingoms darbuotoj\u0173 grup\u0117ms?<\/strong><\/p>\n<p style=\"text-align: justify;\">Taip, kadangi prastova skelbiama \u012fmon\u0117s vadovo (ar kito \u012fgalioto asmens) sprendimu, \u012fmon\u0117s vadovas (kitas \u012fgaliotas asmuo) gali nuspr\u0119sti prastov\u0105 paskelbti tik tam tikroms darbuotoj\u0173 grup\u0117ms, kurios \u0161iuos metu negali atlikti darbo. Taip pat galima tam tikroms grup\u0117ms nustatyti prastov\u0105 visam darbo laikui, o kitoms \u2013 dalin\u0119 prastov\u0105. Bet kuriuo atveju, skirting\u0173 prastovos s\u0105lyg\u0173 taikymas turi b\u016bti pagr\u012fstas atitinkamomis prie\u017eastimis ar \u012frodymais (pvz. tam tikros darbuotoj\u0173 grup\u0117s yra labiau paveiktos karantino nei kitos).<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>7.\u00a0<\/strong><strong>Ar gali b\u016bti paskelbta prastova tik tam tikriems darbuotojams?<\/strong><\/p>\n<p style=\"text-align: justify;\">Taip, ta\u010diau tik tuo atveju, jei darbuotojai nebus diskriminuojami. Visais atvejais prastovos skelbimas tik tam tikriems darbuotojams turi b\u016bti pagr\u012fstas tam tikromis prie\u017eastimis ar \u012frodymais (pvz. tam tikri darbuotojai yra labiau paveikti karantino nei kiti).<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>8.\u00a0<\/strong><strong>Ar prastovos metu darbuotojas gali dirbti?<\/strong><\/p>\n<p style=\"text-align: justify;\">Paskelbus visi\u0161k\u0105 prastov\u0105, t.y. visam darbuotojo darbo laikui darbuotojas dirbti negali. Paskelbus dalin\u0119 prastov\u0105 darbuotojas gali dirbti maksimaliai 3 dienas per savait\u0119 arba 5 val. per dien\u0105.<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>9.\u00a0<\/strong><strong>Ar paskelbus prastov\u0105 darbuotojams galima mok\u0117ti priedus ar premijas?<\/strong><\/p>\n<p style=\"text-align: justify;\">Tai priklauso nuo pried\u0173 \/ premij\u0173 r\u016b\u0161ies ir paskelbtos prastovos r\u016b\u0161ies (visi\u0161kos arba dalin\u0117s prastovos). Jei paskelbta dalin\u0117 prastova, priedas ar premija gali b\u016bti mokami u\u017e t\u0105 laik\u0105, kai darbuotojas fakti\u0161kai dirba (pavyzd\u017eiui, jei pasiekia jam nustatytus tikslus ar rezultat\u0105). Priedai ar premijos tur\u0117t\u0173 b\u016bti mokami pagal darbdavio bendrov\u0117je patvirtint\u0105 darbo apmok\u0117jimo sistem\u0105 (ar kolektyvin\u0119 sutart\u012f). Bet kuriuo atveju, tuo metu, kai darbuotojas yra prastovoje, jam netur\u0117t\u0173 b\u016bti mokamas didesnis darbo u\u017emokestis, nei nustatyta darbo sutartyje.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><strong>10.\u00a0<\/strong><strong>Ar galima nustatyti dalin\u0119 prastov\u0105, kai darbuotojas dirba 4 dienas per savait\u0119, o 1 dien\u0105 yra prastovoje?<\/strong><\/p>\n<p style=\"text-align: justify;\">Ne, negalima. Lietuvos Respublikos darbo kodekse nuostata d\u0117l dalin\u0117s prastovos formuluojama taip: darbdavys gali paskelbti darbuotojui dalin\u0119 prastov\u0105, kai tam tikram laikotarpiui suma\u017einamas darbo dien\u0173 per savait\u0119 skai\u010dius (ne ma\u017eiau kaip dviem darbo dienomis) ar darbo valand\u0173 per dien\u0105 skai\u010dius (ne ma\u017eiau kaip trimis darbo valandomis). Vadinasi, ma\u017einti darbo laik\u0105 galima ne ma\u017eiau nei 2 d. per savait\u0119 (3 val. per dien\u0105). Jei darbo laikas ma\u017einamas b\u016btent tokia proporcija, darbuotojas dirbt\u0173 3 d. per savait\u0119, o 2 d. per savait\u0119 praleist\u0173 prastovoje.<\/p>\n<p style=\"text-align: justify;\">Galima darbo laik\u0105 ma\u017einti daugiau nei 2 d. per savait\u0119 (pvz. 3 d. per savait\u0119 ar atitinkamai valandomis), tokiu b\u016bdu darbuotojas dirbt\u0173 2 d. per savait\u0119, o 3 d. praleist\u0173 prastovoje.<\/p>\n<p style=\"text-align: justify;\">Neb\u016bt\u0173 galima ma\u017einti darbuotojo darbo laiko tik 1 d. per savait\u0119 arba tik 2 val. per dien\u0105, nes laikoma, kad tokiu atveju darbo suma\u017e\u0117jimas n\u0117ra pakankamas, kad b\u016bt\u0173 \u012fforminta prastova.<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>11.\u00a0<\/strong><strong>K\u0105 daryti, jei prastova paskelbta nuo kovo 16 d., o nauja DK 47 str. redakcija \u012fsigaliojo kovo 19 d.?<\/strong><\/p>\n<p style=\"text-align: justify;\">Reik\u0117t\u0173 iki kovo 19 d. apmok\u0117ti darbuotojams u\u017e darb\u0105 pagal tuo metu galiojusi\u0105 47 str. redakcij\u0105. Rekomenduojama priimti \u012fsakymus, kurie patikslint\u0173 mok\u0117jimo tvark\u0105 nuo kovo 19 d. pagal nauj\u0105 DK 47 str. redakcij\u0105.<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>12.\u00a0<\/strong><strong>Ar tiesa, kad negaliu skelbti prastovos d\u0117l karantino, jei \u012fmanoma suorganizuoti darbuotoj\u0173 darb\u0105 nuotoliniu b\u016bdu?<\/strong><\/p>\n<p style=\"text-align: justify;\">Remiantis oficialiu Valstybin\u0117s darbo inspekcijos i\u0161ai\u0161kinimu, prastov\u0105 skelbti galima, ta\u010diau kol kas n\u0117ra \u012fmanoma u\u017etikrinti, kad bus i\u0161mok\u0117ta subsidija.<\/p>\n<p style=\"text-align: justify;\">Tokiu atveju, kai darb\u0105 organizuoti nuotoliniu b\u016bdu galima, ta\u010diau n\u0117ra galimyb\u0117s to darbo suteikti d\u0117l karantino, darbuotojams galima skelbti prastov\u0105 ir u\u017e tai bus i\u0161mokama subsidija.<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>13.\u00a0<\/strong><strong>Ar reikia prane\u0161ti apie prastovos paskelbim\u0105? Kada?<\/strong><\/p>\n<p style=\"text-align: justify;\">Taip, apie prastovos paskelbim\u0105 reikia prane\u0161ti Valstybinei darbo inspekcijai per 3 d. d. nuo naujos redakcijos DK 47 str. \u012fsigaliojimo. Kadangi min\u0117to straipsnio pakeitimai \u012fsigaliojo baland\u017eio 8 d., paskutin\u0117 diena pateikti prane\u0161im\u0105 buvo baland\u017eio 13 d. Jei prastova buvo paskelbta po naujos redakcijos DK 47 str. \u012fsigaliojimo, prane\u0161ti reikia per 1 d.d.<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>14.\u00a0<\/strong><strong>Kokio dyd\u017eio darbo u\u017emokestis darbuotojui tur\u0117t\u0173 b\u016bti mokamas prastovos laikotarpiu?<\/strong><\/p>\n<p class=\"m-7060553220580438048msolistparagraph\" style=\"text-align: justify;\">Ne ma\u017eesnis nei minimali m\u0117nesin\u0117 alga, t.y. 607 EUR (bruto), kai darbuotojui nustatytas visas darbo laikas. Jei darbuotojui paskelbta dalin\u0117 prastova, mokama proporcinga 607 EUR dalis, pvz. 50% laiko dirbant ir 50% laiko praleid\u017eiant prastovoje, darbuotojui mokama 50% jo \u012fprasto darbo u\u017emokes\u010dio + ne ma\u017eiau nei 303,5 EUR (bruto).<\/p>\n<p class=\"m-7060553220580438048msolistparagraph\" style=\"text-align: justify;\">Ta\u010diau darbdavys gali pasirinkti mok\u0117ti didesn\u012f nei MMA darbo u\u017emokest\u012f prastovos laikotarpiu. Pavyzd\u017eiui, jei darbuotojo darbo sutartyje nustatytas 1000 EUR bruto darbo u\u017emokestis (darbuotojui dirbant vis\u0105 dien\u0105), prastovos laikotarpiu darbdavys gal\u0117t\u0173 pasirinkti mok\u0117ti nuo 607 EUR iki 1000 EUR darbo u\u017emokes\u010dio (tuo atveju, jei darbuotojas praleid\u017eia prastovoje vis\u0105 darbo laik\u0105). Kadangi nuo prastovos laikotarpiu mok\u0117to darbo u\u017emokes\u010dio priklausys darbdaviui skiriamos subsidijos dydis, darbdavys gali b\u016bti suinteresuotas mok\u0117ti daugiau nei MMA prastovos laikotarpiu siekdamas i\u0161laikyti darbuotojus.<\/p>\n<p class=\"m-7060553220580438048msolistparagraph\" style=\"text-align: justify;\"><strong>15.\u00a0<\/strong><strong>Ar prastovos metu darbuotojui gali b\u016bti mokamas didesnis darbo u\u017emokestis, nei sutartas darbo sutartyje?<\/strong><\/p>\n<p class=\"m-7060553220580438048msolistparagraph\" style=\"text-align: justify;\">Ne. Pavyzd\u017eiui, jei darbuotojo darbo sutartyje nustatytas 1000 EUR bruto darbo u\u017emokestis darbuotojui dirbant vis\u0105 dien\u0105, prastovos laikotarpiu darbdavys gal\u0117t\u0173 pasirinkti mok\u0117ti nuo 607 EUR iki 1000 EUR darbo u\u017emokes\u010dio (tuo atveju, jei darbuotojas praleid\u017eia prastovoje vis\u0105 darbo laik\u0105).<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>16.\u00a0<\/strong><strong>Kas gal\u0117s gauti subsidij\u0105?<\/strong><\/p>\n<p style=\"text-align: justify;\">Remiantis naujausia DK 47 str. redakcija, subsidij\u0105 gaus tik tie darbdaviai, kurie paskelbs prastov\u0105 d\u0117l to, kad Lietuvos Respublikos Vyriausyb\u0117 paskelbia ekstremali\u0105j\u0105 situacij\u0105 ir karantin\u0105 ir darbdavys d\u0117l to negali suteikti darbuotojui darbo sutartyje sulygto darbo, nes d\u0117l darbo organizavimo ypatum\u0173 n\u0117ra galimyb\u0117s sulygto darbo dirbti nuotoliniu b\u016bdu arba darbuotojas nesutinka dirbti kito jam pasi\u016blyto darbo. Taigi, tur\u0117t\u0173 b\u016bti patenkintos \u0161ios aplinkyb\u0117s:<\/p>\n<p style=\"text-align: justify;\">&#8211; Paskelbta prastova pagal DK 47 str. 1 d. 2 p. (visi\u0161ka arba dalin\u0117);<\/p>\n<p style=\"text-align: justify;\">&#8211; Apie prastov\u0105 nustatyta tvarka informuota VDI ir darbuotojai;<\/p>\n<p style=\"text-align: justify;\">&#8211; N\u0117ra \u012fsiskolinim\u0173 darbuotojams;<\/p>\n<p style=\"text-align: justify;\">&#8211; Darbdavys n\u0117ra biud\u017eetin\u0117 \u012fstaiga;<\/p>\n<p style=\"text-align: justify;\">&#8211; Darbdaviui n\u0117ra i\u0161kelta bankroto byla, prad\u0117tas likvidavimas procesas;<\/p>\n<p style=\"text-align: justify;\">&#8211; Darbdavys (jo atsakingi asmenys) atitinka reikalavimus d\u0117l baud\u0173:<\/p>\n<ul style=\"text-align: justify;\">\n<li>12 m\u0117n. iki kreipimosi negali b\u016bti paskirta <strong>jokia bauda <\/strong>u\u017e nelegal\u0173\/nedeklaruot\u0105 darb\u0105, u\u017esienie\u010di\u0173 \u012fdarbinimo pa\u017eeidimus<\/li>\n<li>12 m\u0117n. iki kreipimosi gali b\u016bti paskirta <strong>ne daugiau nei viena bauda <\/strong>u\u017e kitus pa\u017eeidimus (darbo laiko \/ u\u017emokes\u010dio apskaita, darbo sauga ir pan.)<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u00a0<strong>17.\u00a0<\/strong><strong>Ar tiesa, kad darbdavys neturi tur\u0117ti gin\u010d\u0173\/byl\u0173 su darbuotojais DGK ar teisme nor\u0117damas gauti subsidij\u0105?<\/strong><\/p>\n<p style=\"text-align: justify;\">Ne, netiesa, ta\u010diau darbdavys turi b\u016bti atsiskait\u0119s su darbuotojais, d\u0117l kuri\u0173 darbo u\u017emokes\u010dio subsidijavimo kreipiasi.<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>18.\u00a0<\/strong><strong>Ar darbdavys gal\u0117s pretenduoti \u012f subsidij\u0105, jei paskelb\u0117 dalin\u0119 prastova?<\/strong><\/p>\n<p style=\"text-align: justify;\">Taip, tuo atveju, jei prastova paskelbta DK 47 str. 1 d. 2 p. pagrindu ir darbdavys tenkina visas kitas subsidijos skyrimo s\u0105lygas.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><strong>19.\u00a0<\/strong><strong>Kokie subsidijos dyd\u017eiai?<\/strong><\/p>\n<p class=\"m-7060553220580438048msolistparagraph\" style=\"text-align: justify;\">Subsidijos dydis apskai\u010diuojamas procentais nuo prastovoje esan\u010diam darbuotojui priskai\u010diuoto ir i\u0161mok\u0117to darbo u\u017emokes\u010dio.<\/p>\n<p class=\"m-7060553220580438048msolistparagraph\" style=\"text-align: justify;\">&#8211;\u00a0<strong>70 proc.<\/strong> nuo darbuotojui priskai\u010diuoto darbo u\u017emokes\u010dio, bet ne daugiau nei <strong>910,5 EUR bruto<\/strong>.<\/p>\n<p class=\"m-7060553220580438048msolistparagraph\" style=\"text-align: justify;\">&#8211;\u00a0<strong>90 proc.<\/strong> nuo darbuotojui priskai\u010diuoto darbo u\u017emokes\u010dio, bet ne daugiau nei <strong>607 EUR bruto<\/strong>.<\/p>\n<p class=\"m-7060553220580438048msolistparagraph\" style=\"text-align: justify;\">Darbdavys pats renkasi tinkamiausi\u0105 subsidijos dyd\u012f. Jeigu darbuotojui prastova DK 47 straipsnio 1 dalies 2 punkte nustatytu atveju paskelbta\u00a0<strong>ne vis\u0105 m\u0117nesio darbo laik\u0105<\/strong><strong>, subsidijos\u00a0<\/strong><strong>dydis apskai\u010diuojamas proporcingai<\/strong><strong>\u00a0<\/strong>darbdavio paskelbtam darbuotojo prastovos laikui.\u00a0<strong>Subsidija<\/strong><strong>\u00a0<\/strong><strong>mokama, kol t\u0119siasi ekstremali situacija ir karantinas<\/strong><strong>.<\/strong><\/p>\n<p class=\"m-7060553220580438048msolistparagraph\" style=\"text-align: justify;\"><strong>20.\u00a0<\/strong><strong>Kiek laiko reik\u0117s i\u0161laikyti darbuotojus, jei darbdavys gauna subsidij\u0105?<\/strong><\/p>\n<p style=\"text-align: justify;\">Darbdavys turi i\u0161laikyti ne ma\u017eiau kaip 50% darbo viet\u0173 ne trumpiau kaip 3 m\u0117nesius nuo subsidijos darbo u\u017emokes\u010diui mok\u0117jimo pabaigos.<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>21.\u00a0<\/strong><strong>Jei iki pakeitim\u0173 \u012fsigaliojimo darbdavys atleido 10 darbuotoj\u0173, o kitiems 10 paskelb\u0117 prastov\u0105. <\/strong><strong>Ar bus galima kreiptis d\u0117l subsidij\u0173?<\/strong><\/p>\n<p style=\"text-align: justify;\">U\u017eimtumo tarnybos teigimu kreiptis d\u0117l subsidij\u0173 bus galima, ta\u010diau \u0161i informacija n\u0117ra \u012ftraukta \u012f teis\u0117s akt\u0173 projektus ar kit\u0105 \u0161iuo metu oficialiai komunikuojam\u0105 informacij\u0105. Tokiu atveju darbdavys tur\u0117s \u012fsipareigoti i\u0161laikyti 50 proc. darbo viet\u0173, t.y. 5 darbuotojus.<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>22.\u00a0<\/strong><strong>Kaip ir kur kreiptis d\u0117l subsidijos?<\/strong><\/p>\n<p style=\"text-align: justify;\">Dokumentai d\u0117l subsidijos skyrimo pateikiami:<\/p>\n<ol style=\"text-align: justify;\">\n<li>elektroniniu pa\u0161tu, siun\u010diant el. para\u0161u pasira\u0161yt\u0105 pasira\u0161ytus dokumentus \u012f U\u017eimtumo tarnybos Klient\u0173 aptarnavimo departament\u0105, kurio aptarnaujamoje teritorijoje yra registruota darbdavio buvein\u0117;<\/li>\n<li>pa\u0161tu, siun\u010diant \u012fprastu para\u0161u pasira\u0161ytus dokumentus \u012f U\u017eimtumo tarnybos Klient\u0173 aptarnavimo skyri\u0173, kurio aptarnaujamoje teritorijoje yra registruota darbdavio buvein\u0117.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Gautas nepasira\u0161yti arba netinkamai pasira\u0161yti dokumentai bus gr\u0105\u017einami juos pateikusiam darbdaviui.<\/p>\n<p style=\"text-align: justify;\"><strong>23.
