Neretai siekiant paskatinti darbuotojus jiems skiriamos \u012fvairios premijos ar priedai, ta\u010diau retai susim\u0105stoma, kokios \u0161i\u0173 premij\u0173 mok\u0117jimo pasekm\u0117s.<\/strong><\/p>\n<p style=\"text-align: justify;\">Darbo kodekse i\u0161skirtos dviej\u0173 r\u016b\u0161i\u0173 premijos \u2013 premija u\u017e atlikt\u0105 darb\u0105 bei premija darbdavio iniciatyva, o kiekvienos i\u0161 j\u0173 mok\u0117jimas sukelia skirtingas pasekmes. Remiantis Darbo kodekso 142 straipsniu, darbdavys gali atsisakyti mok\u0117ti tik premij\u0105, kuri nustatyta (mokama) darbdavio iniciatyva. Nors premijos darbdavio iniciatyva po\u017eymiai pla\u010diau Darbo kodekse neaptarti, ta\u010diau juos galima nustatyti ai\u0161kinant kit\u0105 premij\u0173 r\u016b\u0161\u012f \u2013 premijas u\u017e atlikt\u0105 darb\u0105. Svarbu tai, kad vien formuluot\u0117s, jog premija mokama darbdavio iniciatyva \u012ftraukimo \u012f darbo sutart\u012f ar kitus dokumentus nepakaks, nes gin\u010do atveju b\u016bt\u0173 vertinama, ar tokia premija neatitinka premijos u\u017e atlikt\u0105 darb\u0105 kriterij\u0173.<\/p>\n<h4 style=\"text-align: justify;\"><strong>Darbuotoj\u0173 premijos: skiriamos darbdavio iniciatyva ar u\u017e pasiektus tikslus?<\/strong><\/h4>\n<p style=\"text-align: justify;\">Daugiausia klausim\u0173 \u012fprastai kyla d\u0117l to, ar tam tikri priedai ar premijos yra skiriamos darbdavio iniciatyva, ar u\u017e tikslus (rodiklius, kitaip vadinamus <em>KPIs<\/em> arba <em>key performace indicators<\/em>), kurie buvo nustatyti darbuotojui i\u0161 anksto ir kuriuos jis pasiek\u0117. \u0160iuo klausimu teism\u0173 praktikoje dar iki \u012fsigaliojant naujajam Darbo kodeksui buvo suformuotos gan ai\u0161kios taisykl\u0117s, kad premija u\u017e tiksl\u0173 ar rodikli\u0173 pasiekim\u0105 laikoma darbo u\u017emokes\u010dio dalimi. Kaip numatyta Darbo kodekse, tokios premijos darbdavys negal\u0117t\u0173 atsisakyti mok\u0117ti net ir tuo atveju, jei darbuotojas padaro darbo pareig\u0173 pa\u017eeidim\u0105.
