Su naujov\u0117mis jau apsipratome, taigi kyla klausimas, koki\u0173 tendencij\u0173 galime laukti 2018-aisiais?<\/strong><\/p>\n<h4><strong>Daug\u0117s gin\u010d\u0173 d\u0117l diskriminacijos<\/strong><\/h4>\n<p>Naujajame Darbo kodekse \u017eymiai didesnis d\u0117mesys skiriamas diskriminacijai. Diskriminacij\u0105 apra\u0161an\u010dios nuostatos yra gana i\u0161samios, siekiama geriau atskleisti ir paai\u0161kinti diskriminacijos s\u0105vok\u0105 pateikiant tam tikrus pavyzd\u017eius. Tik\u0117tina, jog didel\u0117 dalis darbdavi\u0173 priims arba jau pri\u0117m\u0117 lygi\u0173 galimybi\u0173 politikos \u012fgyvendinimo ir vykdymo prie\u017ei\u016bros priemones, atsi\u017evelgiant \u012f tai, jog tokia pareiga nustatyta visiems daugiau nei 50 darbuotoj\u0173 turintiems darbdaviams.<\/p>\n<p>Svarbu ir tai, kad nagrin\u0117jant ly\u010di\u0173 lygyb\u0117s ir nediskriminavimo kitais pagrindais bylas, susijusias su darbo santykiais, taikoma atvirk\u0161tin\u0117 \u012frodin\u0117jimo pareiga, t.y. darbuotojui nurod\u017eius aplinkybes, leid\u017eian\u010dias daryti prielaid\u0105, kad darbuotojas patyr\u0117 diskriminacij\u0105, darbdavys prival\u0117s \u012frodyti, kad diskriminacijos nebuvo. \u012eprastai \u0161alis, kuri nurodo tam tikras aplinkybes, privalo pateikti tas aplinkybes pagrind\u017eian\u010dius \u012frodymus, tod\u0117l toks atvirk\u0161tin\u0117s \u012frodin\u0117jimo pareigos taikymas paskatins darbuotojus inicijuoti gin\u010dus d\u0117l diskriminacijos.<\/p>\n<p>\u012esp\u016bd\u012f, kad gin\u010d\u0173 d\u0117l diskriminacijos daug\u0117s, sustiprina ir paskutin\u0117s Europos Teisingumo Teismo bylos. Byloje Esoterikon v. Kalliri buvo konstatuota, kad Graikijos policijos pareig\u016bnams nustatytas atrankos kriterijus &#8211; minimalus 1,7 metr\u0173 \u016bgis netiesiogiai diskriminuoja moteris. Byloje Otero Ramos v. Galego de Saude konstatuota, kad darbdavys atsisak\u0119s vykdyti individual\u0173 darbo s\u0105lyg\u0173 rizikos vertinim\u0105 pa\u017eeid\u0117 darbuotojos, maitinan\u010dios k\u016bdik\u012f kr\u016btimi, teises, tokiu b\u016bdu j\u0105 diskriminuodamas lyties pagrindu.<\/p>\n<h4><strong>Sustipr\u0117s dialogas su darbuotoj\u0173 atstovais<\/strong><\/h4>\n<p>Iki \u012fsigaliojant naujajam Darbo kodeksui, dialogo su darbuotoj\u0173 atstovais, galima sakyti, nebuvo. Retais atvejais darbuotojai \u012fsteigdavo \u012fmon\u0117je veikian\u010di\u0105 profesin\u0119 s\u0105jung\u0105, o dar re\u010diau buvo renkamos darbo tarybos. Kadangi naujajame Darbo kodekse nustatytos ai\u0161kios informavimo ir konsultavimo pareigos ne tik vykdant verslo perleidim\u0105 ar ruo\u0161iantis atleisti grup\u0119 darbuotoj\u0173, ta\u010diau ir tvirtinant darbdavio lokalinius teis\u0117s aktus, tik\u0117tina, kad darbuotoj\u0173 atstovai savo teis\u0117mis gauti informacij\u0105 ir reik\u0161ti nuomon\u0119 naudosis \u017eymiai aktyviau. Be to, reik\u0117t\u0173 atkreipti d\u0117mes\u012f, jos darbdavys ne re\u010diau nei kart\u0105 per metus prival\u0117s vykdyti reguliariojo informavimo ir konsultavimo pareigas, teikti duomenis apie darbuotoj\u0173 darbo u\u017emokest\u012f ir kit\u0105 informacij\u0105.<\/p>\n<p>Neder\u0117t\u0173 u\u017emir\u0161ti, kad Darbo kodekse \u012ftvirtinta galimyb\u0117 darbo tarybai ir darbdaviui sudaryti susitarim\u0105 d\u0117l darbo tarybos kompetencijos \u012fgyvendinimo, veiklos organizavimo, finansavimo, papildom\u0173 garantij\u0173 darbo tarybos nariams. \u0160ia galimybe darbo tarybos jau ima po truput\u012f naudotis, tod\u0117l tik\u0117tina, kad dialogas tarp darbuotoj\u0173 atstov\u0173 ir darbdavio ne tik atsiras, bet ir sustipr\u0117s.<\/p>\n<p>D\u0117l \u0161i\u0173 prie\u017eas\u010di\u0173, 2018 metais galime sulaukti \u012fdomi\u0173 precedento neturin\u010di\u0173 gin\u010d\u0173, susijusi\u0173 su darbdavio pareig\u0173 vykdymu darbuotoj\u0173 atstov\u0173 at\u017evilgiu, atsisakymo suteikti tam tikras garantijas ir pan.<\/p>\n<h4><strong>D\u0117mesys darbuotoj\u0173 nekonkuravimui ir konfidencialios informacijos apsaugai nema\u017e\u0117s <\/strong><\/h4>\n<p>Naujuoju Darbo kodeksu buvo \u012ftvirtinta, jog susitarimams d\u0117l konfidencialios informacijos apsaugos ir nekonkuravimo yra taikomos darbo teis\u0117s normos. Kodekse tiesiogiai draud\u017eiama sudaryti civilinio pob\u016bd\u017eio susitarimus d\u0117l Darbo kodekse nustatyt\u0173 teisi\u0173 ir pareig\u0173 \u012fgyvendinimo. Svarbu tai, kad naujojo Darbo kodekso norm\u0173 d\u0117l konfidencialios informacijos apsaugos ir darbuotoj\u0173 nekonkuravimo pagrindas did\u017ei\u0105ja dalimi buvo Lietuvos Auk\u0161\u010diausiojo Teismo praktika. Taigi, tam tikros teism\u0173 praktikoje suformuotos taisykl\u0117s buvo perkeltos \u012f nauj\u0105j\u012f Darbo kodeks\u0105.
