{"id":27667,"date":"2023-10-08T22:28:21","date_gmt":"2023-10-08T19:28:21","guid":{"rendered":"https:\/\/stage.www.cobalt.legal\/?p=27667"},"modified":"2023-10-08T22:28:21","modified_gmt":"2023-10-08T19:28:21","slug":"ar-galima-nutraukti-darbo-sutarti-del-reorganizacijos","status":"publish","type":"post","link":"https:\/\/www.cobalt.legal\/lt\/news-cases\/ar-galima-nutraukti-darbo-sutarti-del-reorganizacijos\/","title":{"rendered":"Ar galima nutraukti darbo sutart\u012f d\u0117l reorganizacijos?"},"content":{"rendered":"<p class=\"intro\"><strong>Lietuvos Respublikos darbo kodekso (toliau \u2013 Darbo kodeksas) 57 straipsnyje \u012ftvirtinta galimyb\u0117 nutraukti darbo sutart\u012f darbdavio iniciatyva be darbuotojo kalt\u0117s tuo atveju, kai darbuotojo atliekama funkcija darbdaviui tampa pertekline d\u0117l darbo organizavimo pakeitim\u0173 ar kit\u0173 prie\u017eas\u010di\u0173, susijusi\u0173 su darbdavio veikla.<\/strong><\/p>\n<p>Svarbu tai, kad darbo organizavimo pakeitimai, t.y. reorganizacija ar kiti strukt\u016briniai pertvarkymai, gali b\u016bti laikomi pakankamomis prie\u017eastimis nutraukti darbo sutart\u012f tik tuo atveju, kai jie yra real\u016bs ir lemia konkretaus darbuotojo atliekamos darbo funkcijos nereikalingum\u0105.<\/p>\n<p>Vadinasi, darbdavys tur\u0117t\u0173 pagr\u012fsti reorganizacijos realum\u0105 ir aplinkyb\u0119, jog reorganizacija (strukt\u016briniai pertvarkymai) lemia b\u016btent to darbuotojo darbo funkcijos nereikalingum\u0105. \u2028\u2028Darbdavys privalo paai\u0161kinti, kokie strukt\u016briniai pertvarkymai atlikti ir kod\u0117l jie l\u0117m\u0117 b\u016btent J\u016bs\u0173 pareigyb\u0117s nereikalingum\u0105.<\/p>\n<p>Svarbu \u012fvertinti, ar sprendim\u0105 d\u0117l strukt\u016brini\u0173 pertvarkym\u0173 pri\u0117m\u0117 darbdavio vadovas (direktorius), bendrov\u0117s valdyba ar visuotinis akcinink\u0173 (dalinink\u0173) susirinkimas ar kitas darbdavio organas. Tam tikrus sprendimus d\u0117l reorganizavimo (strukt\u016brini\u0173 pertvarkym\u0173) gali priimti tik tam tikras darbdavio organas, kurio kompetencijai priskirta priimti tokius sprendimus darbdavio \u012fstatuose ar darbdavio veiklai taikomuose teis\u0117s aktuose. Jei \u0161i sprendim\u0173 pri\u0117mimo tvarka pa\u017eeista \u2013 J\u016bs\u0173 atleidimas gal\u0117t\u0173 b\u016bti pripa\u017eintas neteis\u0117tu d\u0117l proced\u016brini\u0173 pa\u017eeidim\u0173.<\/p>\n<p>Taip pat reik\u0117t\u0173 nustatyti, ar perteklin\u0119 darbo funkcij\u0105 atlieka vienas darbuotojas, ar keli darbuotojai. Jei toki\u0105 funkcij\u0105 atlieka keli darbuotojai, o siekiama atleisti tik vien\u0105 darbuotoj\u0105 ar dal\u012f j\u0173, Darbo kodekso 57 straipsnio tvarka turi b\u016bti vykdoma atleid\u017eiam\u0173 darbuotoj\u0173 atrankos proced\u016bra. \u0160ios proced\u016bros ne\u012fvykd\u017eius, atleidimas gali b\u016bti pripa\u017eintas neteis\u0117tu.<\/p>\n<p>Nutraukti darbo sutart\u012f d\u0117l darbdavio organizavimo pakeitim\u0173 galima tik tuo atveju, jei laikotarpiu nuo \u012fsp\u0117jimo apie darbo sutarties nutraukim\u0105 iki penki\u0173 darbo dien\u0173 iki \u012fsp\u0117jimo laikotarpio pabaigos darboviet\u0117je n\u0117ra laisvos darbo vietos, \u012f kuri\u0105 darbuotojas gal\u0117t\u0173 b\u016bti perkeltas jo sutikimu. \u2028\u2028Taigi, darbdavys, \u012fteik\u0119s prane\u0161im\u0105 apie darbo sutarties nutraukim\u0105, tur\u0117t\u0173 si\u016blyti darbuotojui laisvas darbo vietas darboviet\u0117je.<\/p>\n<p>Darbuotojas gali b\u016bti atleistas tik tuo atveju, jei darboviet\u0117je n\u0117ra laisv\u0173 darbo viet\u0173, \u012f kurias darbuotojas gal\u0117t\u0173 b\u016bti perkeltas, arba darbuotojas atsisak\u0117 darbdavio pasi\u016blym\u0173.
