Tokiais veiksmais darbdavys siekia \u012fgauti geresn\u0119 derybin\u0119 pozicij\u0105 ir paskatinti darbuotojus atsisakyti ar su\u0161velninti keliamus reikalavimus, kurie da\u017enai susij\u0119 su darbo s\u0105lyg\u0173 gerinimu, darbo u\u017emokes\u010dio k\u0117limu ir pan.<\/p>\n<p>Iki priimant nauj\u0105j\u012f Darbo kodeks\u0105, lokautas Lietuvoje buvo draud\u017eiamas, o darbuotojams prad\u0117jus streikuoti ar kitu b\u016bdu nevykdyti susitarimo su darbdaviu, darbdavys negal\u0117jo imtis joki\u0173 kolektyvini\u0173 gynybos priemoni\u0173.<\/p>\n<p>\u012eteisindama lokaut\u0105 Lietuva prisijungs prie Latvijos ir Estijos, kuriose lokaut\u0105 reglamentuojan\u010dios nuostatos galioja jau gana seniai.<\/p>\n<p>\u012eprastai i\u0161skiriamos dvi lokauto formos: \u201epuolamasis\u201c ir \u201egynybinis\u201c. Pirmuoju atveju, darbdavys taiko tam tikrus veiksmus dar neprad\u0117jusiems streikuoti darbuotojams, antruoju \u2013 darbdavio veiksmai yra atsakas \u012f prad\u0117t\u0105 streik\u0105.<\/p>\n<p>Naujojo Darbo kodekso 243 straipsnyje \u012ftvirtinta, jog darbdavys turi teis\u0119 organizuoti lokaut\u0105 \u0161iais atvejais:<\/p>\n<ul>\n<li>jei profesin\u0117s s\u0105jungos ar j\u0173 organizacijos nevykdo tarpininkavimo metu priimto susitarimo arba darbo arbitra\u017eo sprendimo kolektyvinio darbo gin\u010do d\u0117l interes\u0173 byloje<\/li>\n<li>profesin\u0117s s\u0105jungos ar j\u0173 organizacijos skelbia streik\u0105, kurio skelbimas teismo buvo atid\u0117tas arba pripa\u017eintas neteis\u0117tu.<\/li>\n<\/ul>\n<p><strong>Darbdaviai gal\u0117s laikinai sustabdyti darbo sutar\u010di\u0173 vykdym\u0105<\/strong><\/p>\n<p>Nors lokautas gali pasireik\u0161ti \u012fvairiais veiksmais, naujajame Darbo kodekse \u012ftvirtinta tik viena darbdavio gynybos galimyb\u0117 \u2013 laikinai sustabdyti darbo sutar\u010di\u0173 vykdym\u0105.<\/p>\n<p>Darbo sutar\u010di\u0173 vykdymo sustabdymas rei\u0161kia, jog darbuotojams nebus mokamas darbo u\u017emokestis, bus sustabdytas darbo santyki\u0173 trukm\u0117s skai\u010diavimas, darbo trukm\u0117 kasmetin\u0117ms atostogoms gauti, ta\u010diau i\u0161saugoma teis\u0117 \u012f socialin\u012f draudim\u0105.<\/p>\n<p>Pa\u017eym\u0117tina, jog kaimynin\u0117je Latvijoje darbdaviai turi teis\u0119 sustabdyti darbo sutar\u010di\u0173 vykdym\u0105 bei ne\u012fleisti darbuotoj\u0173 \u012f \u012fmon\u0117s patalpas, o Estijoje be \u0161i\u0173 veiksm\u0173 lokauto metu \u012fmon\u0117 taip pat gali b\u016bti pertvarkyta ar likviduota remiantis bendraisiais pagrindais.<\/p>\n<p>Nei Latvijoje, nei Estijoje kaip lokauto veiksmai n\u0117ra \u012fteisintas darbuotoj\u0173 atleidimas, tokia galimyb\u0117 n\u0117ra \u012ftvirtinta ir Lietuvoje.<\/p>\n<p><strong>Kam bus taikomas lokautas?<\/strong><\/p>\n<p>Lietuvoje lokauto veiksmus darbdavys gali taikyti profesin\u0117s s\u0105jungos, kuri yra gin\u010do \u0161alis, darbuotojams arba streikuojantiems darbuotojams.
