Vi\u0146upr\u0101t, \u0161is pien\u0101kums ir p\u0101rk\u0101pts, uz\u0146\u0113mumam komunic\u0113jot savu poz\u012bciju attiec\u012bb\u0101 uz karu. \u0160\u0101ds arguments parasti tiek pamatots ar to, ka kar\u0161 faktiski notiek starp div\u0101m valst\u012bm, atbalsts k\u0101dai no konflikta pus\u0113m liecinot par atbalst\u012bt\u0101ja politisko p\u0101rliec\u012bbu.<\/p>\n<p>Politisk\u0101 p\u0101rliec\u012bba ir viena no iesp\u0113jam\u0101m diskrimin\u0101cijas paz\u012bm\u0113m. Eiropas Savien\u012bbas Pamatties\u012bbu hartas 21. pants: &#8220;Aizliegta jebk\u0101da veida diskrimin\u0101cija, tostarp diskrimin\u0101cija (..) politisko vai jebkuru citu uzskatu d\u0113\u013c (..)&#8221; un Eiropas Cilv\u0113kties\u012bbu konvencijas 14. pants: &#8220;\u0160aj\u0101 Konvencij\u0101 min\u0113to ties\u012bbu un br\u012bv\u012bbu \u012bsteno\u0161ana ir nodro\u0161in\u0101ma bez jebk\u0101das diskrimin\u0101cijas, neatkar\u012bgi no (..) politiskajiem vai citiem uzskatiem (..)&#8221; paredz, ka personas nevar tikt diskrimin\u0113tas savas politisk\u0101s p\u0101rliec\u012bbas d\u0113\u013c. Lai gan harta un konvencija ir saisto\u0161a t\u0101s dal\u012bbvalst\u012bm (ne priv\u0101tperson\u0101m), t\u0101s principi ir iestr\u0101d\u0101ti ar\u012b Latvijas ties\u012bbu aktos, un \u0161ie Latvijas ties\u012bbu akti ir saisto\u0161i priv\u0101tperson\u0101m (uz\u0146\u0113mumiem). T\u0101 Darba likuma 7. panta otr\u0101 da\u013ca paredz, ka: &#8220;darbinieka ties\u012bbas nodro\u0161in\u0101mas bez jebk\u0101das tie\u0161as vai netie\u0161as diskrimin\u0101cijas \u2014 neatkar\u012bgi no personas (..) reli\u0123isk\u0101s, politisk\u0101s vai citas p\u0101rliec\u012bbas (..)&#8221;.<\/p>\n<p>Darbinieks tiek aizsarg\u0101ts no nelabv\u0113l\u012bg\u0101m sek\u0101m, piem\u0113ram, sal\u012bdzino\u0161i maz\u0101kas darba samaksas, pr\u0113mijas nepie\u0161\u0137ir\u0161anas, nepaaugstin\u0101\u0161anas amat\u0101, slikt\u0101ku atva\u013cin\u0101juma nosac\u012bjumu piem\u0113ro\u0161anas, disciplin\u0101rsoda vai Darba l\u012bguma uzteikuma, ja \u0161\u0101das sekas darbiniekam rad\u012btas vien\u012bgi diskrimin\u0113jo\u0161as paz\u012bmes d\u0113\u013c. Proti, ja attieksme pret darbinieku vienl\u012bdz\u012bgos apst\u0101k\u013cos ir bijusi at\u0161\u0137ir\u012bga tikai at\u0161\u0137ir\u012bbas paz\u012bmes d\u0113\u013c un ja \u0161\u0101da at\u0161\u0137ir\u012bba nav objekt\u012bvi pamatojama, \u0161\u0101da attieksmes at\u0161\u0137ir\u012bba p\u0101rk\u0101pj diskrimin\u0101cijas aizliegumu. Teor\u0113tiski, ja, piem\u0113ram, darbinieks tiek atlaists no darba d\u0113\u013c savu politisko uzskatu pau\u0161anas, tas var\u0113tu liecin\u0101t par iesp\u0113jamu darbinieka diskrimin\u0101ciju, ja atlai\u0161anas pamat\u0101 nav biju\u0161i citi objekt\u012bvi apst\u0101k\u013ci, kas to pamato.<\/p>\n<p>Tom\u0113r, v\u0113rt\u0113jot iesp\u0113jamo diskrimin\u0101ciju, politisk\u0101s p\u0101rliec\u012bbas pau\u0161ana ir j\u0101no\u0161\u0137ir no r\u012bc\u012bbas, kas trauc\u0113 darba procesu uz\u0146\u0113mum\u0101 vai nodara kait\u0113jumu uz\u0146\u0113muma reput\u0101cijai. Darbiniekam nav ties\u012bbu trauc\u0113t uz\u0146\u0113mumam realiz\u0113t \u0161\u012bs ties\u012bbas pat tad, ja vi\u0146a personisk\u0101 nost\u0101ja ir at\u0161\u0137ir\u012bga no uz\u0146\u0113muma poz\u012bcijas.<\/p>\n<p>Lai darbinieks baud\u012btu diskrimin\u0101cijas regul\u0113juma aizsardz\u012bbu, b\u016btu j\u0101konstat\u0113, ka at\u0161\u0137ir\u012bgas attieksmes pamat\u0101 ir bijusi diskrimin\u0113jo\u0161a paz\u012bme \u2013 \u0161aj\u0101 gad\u012bjum\u0101 politisk\u0101 p\u0101rliec\u012bba. Arguments par diskrimin\u0101cijas p\u0101rk\u0101pumu nedarbosies, ja attieksme pret darbinieku ir bijusi cit\u0101da d\u0113\u013c t\u0101, ka darbinieks p\u0101rk\u0101pj uz\u0146\u0113muma darba k\u0101rt\u012bbu vai cit\u0101di nodara kait\u0113jumu uz\u0146\u0113muma interes\u0113m vai reput\u0101cijai.<\/p>\n<p>Ar\u012b jaut\u0101jums par to, vai attieksmes pau\u0161anu pret karu var uzskat\u012bt par politisko p\u0101rliec\u012bbu, ir visai neviennoz\u012bm\u012bgs. Kara ve\u0161anu regul\u0113 starptautisko ties\u012bbu normas, kas saisto\u0161as ar\u012b karojo\u0161\u0101m valst\u012bm.
