Priek\u0161likumu pakete sast\u0101v no:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Tre\u0161\u0101s maks\u0101jumu pakalpojumu direkt\u012bvas (PSD3; angl. <em>Payment Services Directive 3<\/em>);<\/li>\n<li>Maks\u0101jumu pakalpojumu regula (PSR; angl. <em>Payment Services Regulation<\/em>);<\/li>\n<li>Regula par finan\u0161u datu piek\u013cuvi (FIDA regula; angl. <em>Financial Data Access Regulation<\/em>).<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">K\u0101 2023.\u00a0gada 28.\u00a0j\u016bnija run\u0101<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> nor\u0101d\u012bja Eiropas Komisijas priek\u0161s\u0113d\u0113t\u0101jas izpildvietnieks V.Dombrovskis, priek\u0161likumi neparedz lielas p\u0101rmai\u0146as, un tie b\u016btu j\u0101uzskata par t\u0101diem, kas veicina ES maks\u0101jumu sist\u0113mas att\u012bst\u012bbu, nevis revol\u016bciju. Tiek pausts viedoklis, ka direkt\u012bvas pan\u0101kumi ir stingr\u0101s klientu autentifik\u0101cijas (SCA; angl. <em>Secure Customer Authentication<\/em>) ievie\u0161ana, k\u0101 ar\u012b efektivit\u0101tes, caurskat\u0101m\u012bbas un maks\u0101jumu instrumentu izv\u0113les palielin\u0101\u0161ana maks\u0101jumu pakalpojumu lietot\u0101jiem. Nov\u0113rt\u0113jum\u0101 tom\u0113r ar\u012b konstat\u0113ts, ka PSD2 nesp\u0113ja pan\u0101kt vienl\u012bdz\u012bgus konkurences apst\u0101k\u013cus bank\u0101m un nebanku maks\u0101jumu pakalpojumu sniedz\u0113jiem, un joproj\u0101m ir probl\u0113mas saist\u012bb\u0101 ar t.s. \u201c<em>Open Banking<\/em>\u201d jeb banku atv\u0113rto sadarb\u012bbas platformu datu piek\u013cuves saskarn\u0113m.<\/p>\n<p style=\"text-align: justify;\">Sp\u0113k\u0101 eso\u0161ais tiesiskais regul\u0113jums, kas piem\u0113rojams maks\u0101jumu iest\u0101d\u0113m un elektronisk\u0101s naudas iest\u0101d\u0113m un kuras ir nostiprin\u0101tas PSD2 un otraj\u0101 Elektronisk\u0101s naudas iest\u0101\u017eu direkt\u012bv\u0101<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> (EMD2), tiks apvienotas vien\u0101 noteikumu kopum\u0101, ko veidos jaun\u0101 PSD3 un PSR. Priek\u0161likums paredz atcelt PSD2, lai k\u013c\u016btu par PSD3, un tiks izveidota maks\u0101jumu pakalpojumu regula (PSR), kurai b\u016btu tie\u0161a ietekme uz dal\u012bbvalst\u012bm, lai nov\u0113rstu pa\u0161reiz\u0113j\u0101s at\u0161\u0137ir\u012bbas pras\u012bbu \u012bsteno\u0161an\u0101 \u00a0un izpild\u0113. PSR b\u016bs ietvertas maks\u0101jumu iest\u0101d\u0113m (taj\u0101 skait\u0101 elektronisk\u0101s naudas iest\u0101d\u0113m) piem\u0113rojam\u0101s r\u012bc\u012bbas pras\u012bbas, caursp\u012bd\u012bguma un inform\u0101cijas snieg\u0161anas pras\u012bbas, k\u0101 ar\u012b noteikumi par maks\u0101jumu un elektronisk\u0101s naudas pakalpojumu lietot\u0101ju ties\u012bb\u0101m un pien\u0101kumiem. Turkl\u0101t, pras\u012bbas par stingro klientu autentifik\u0101ciju (SCA) turpm\u0101k b\u016bs ar\u012b ietvertas PSR. Lai vis\u0101 Eiropas Savien\u012bb\u0101 pan\u0101ktu vienotu un saska\u0146otu maks\u0101jumu pakalpojumu tiesisk\u0101 regul\u0113juma piem\u0113ro\u0161anu, noteikumi par piem\u0113ro\u0161anas jomu un iz\u0146\u0113mumiem tiks p\u0101rvietoti no direkt\u012bvas uz jauno PSR regulu.<\/p>\n<p style=\"text-align: justify;\">Elektronisk\u0101s naudas iest\u0101des k\u013c\u016bs par maks\u0101jumu iest\u0101\u017eu apak\u0161kategoriju. Turkl\u0101t Komisija ir ierosin\u0101jusi jaunu elektronisk\u0101s naudas pakalpojumu defin\u012bciju, kas aptver elektronisk\u0101s naudas emit\u0113\u0161anu, maks\u0101jumu kontu uztur\u0113\u0161anu, kuros glab\u0101 elektronisk\u0101s naudas vien\u012bbas, un elektronisk\u0101s naudas p\u0101rskait\u012bjumus.<\/p>\n<p style=\"text-align: justify;\">Jauna maks\u0101juma instrumenta defin\u012bcija tiek ietverta gan PSD3, gan PSR, un attieksies uz visiem individualiz\u0113tiem instrumentiem (nevis, personaliz\u0113tiem k\u0101 paredz \u0161obr\u012bd PSD2). T\u0101d\u0113j\u0101di tiks preciz\u0113ts, ka ar\u012b piln\u012bb\u0101 nepersonaliz\u0113ti instrumenti (piem\u0113ram, priek\u0161apmaksas kartes bez klienta v\u0101rda uz tiem) skaidri atbild\u012bs maks\u0101juma instrumenta defin\u012bcijai.<\/p>\n<p style=\"text-align: justify;\">Komisija groz\u012bjusi ar\u012b maks\u0101jumu konta defin\u012bciju, preciz\u0113jot, ka noteico\u0161ais krit\u0113rijs konta klasific\u0113\u0161anai par maks\u0101jumu kontu cita starp\u0101 b\u016bs klienta sp\u0113ja veikt maks\u0101jumu dar\u012bjumus ar tre\u0161aj\u0101m person\u0101m. T\u0101d\u0113j\u0101di, Komisija ir uzsv\u0113rusi, ka strukt\u016br\u0101m, kur\u0101m ir nepiecie\u0161ams cits starpnieka konts, lai izpild\u012btu maks\u0101jumu oper\u0101cijas adres\u0113tas vai sa\u0146emamas no tre\u0161aj\u0101m person\u0101m, nevajadz\u0113tu ietvert maks\u0101jumu konta defin\u012bcij\u0101.<\/p>\n<p style=\"text-align: justify;\">Maks\u0101jumu instrumentu izlai\u0161ana un maks\u0101jumu pie\u0146em\u0161anas pakalpojumi, kas tika uzskait\u012bti kop\u0101 PSD2, tagad ir atsevi\u0161\u0137i uzskait\u012bti ierosin\u0101taj\u0101s PSR un PSD3.<\/p>\n<p style=\"text-align: justify;\">FIDA regula paredz noteikt skaidru ties\u012bbu un pien\u0101kumu apjomu attiec\u012bb\u0101 uz pla\u0161\u0101ku klientu finan\u0161u datu izmanto\u0161anu un koplieto\u0161anas p\u0101rvald\u012bbu finan\u0161u sektor\u0101 (t.sk. ar\u012b \u0101rpus maks\u0101jumiem), un padar\u012bt atv\u0113rt\u0101ku un viegl\u0101ku piek\u013cuvi klientiem uz datiem balst\u012btajiem finan\u0161u pakalpojumiem un produktiem (angl. <em>data-driven financial services<\/em>). Priek\u0161likums ir izstr\u0101d\u0101ts ar m\u0113r\u0137i veicin\u0101t vair\u0101k inov\u0101ciju finan\u0161u produktos un pakalpojumos un stimul\u0113t konkurenci finan\u0161u nozar\u0113. Komisija pl\u0101no uzlabot piek\u013cuvi kvalitat\u012bv\u0101kiem finan\u0161u pakalpojumiem, pied\u0101v\u0101jot personaliz\u0113tus un vair\u0101k uz lietot\u0101ju orient\u0113tus pakalpojumus, k\u0101 ar\u012b uzlabot to cenu un kvalit\u0101ti. Komisija cer, ka iepriek\u0161 apgr\u016btino\u0161ie procesi k\u013c\u016bs \u0113rt\u0101ki un l\u0113t\u0101ki. Piem\u0113ram, ja kred\u012btsp\u0113jas dati b\u016btu pieejam\u0101ki, klienti var\u0113tu piek\u013c\u016bt pla\u0161\u0101kam un konkur\u0113tsp\u0113j\u012bg\u0101kam finan\u0161u pakalpojumu un produktu kl\u0101stam.<\/p>\n<p style=\"text-align: justify;\">Turpm\u0101k piev\u0113rs\u012bsimies vair\u0101kiem svar\u012bg\u0101kiem izmai\u0146u aspektiem, ko ievie\u0161 priek\u0161likumu pakete.<\/p>\n<p style=\"text-align: justify;\"><strong>Piem\u0113ro\u0161anas iz\u0146\u0113mumi<\/strong><\/p>\n<p style=\"text-align: justify;\">Viens no vispla\u0161\u0101k izmantotajiem iz\u0146\u0113mumiem atbilsto\u0161i PSD2 ir t\u0101 sauktais ierobe\u017eot\u0101 t\u012bkla iz\u0146\u0113mums<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a>. To paredz\u0113ts detaliz\u0113t\u0101k skaidrot ar Eiropas Banku iest\u0101des regulat\u012bviem tehniskiem standartiem (t.s. RTS). Pa\u0161laik viena \u0161\u012b iz\u0146\u0113muma da\u013ca attiecas uz atsevi\u0161\u0137iem maks\u0101\u0161anas l\u012bdzek\u013ciem, kas \u013cauj to tur\u0113t\u0101jam ieg\u0101d\u0101ties preces vai pakalpojumus tikai izdev\u0113ja telp\u0101s vai ierobe\u017eot\u0101 pakalpojumu sniedz\u0113ju t\u012bkl\u0101. PSR sa\u0161aurina \u0161o iz\u0146\u0113muma da\u013cu, preciz\u0113jot, ka \u201ctelpas\u201d noz\u012bm\u0113 emitenta fizisk\u0101s telpas un neietver tie\u0161saistes veikala vidi, bet \u201cierobe\u017eot\u0101 t\u012bkl\u0101\u201d noz\u012bm\u0113 \u201cvien\u0101 ierobe\u017eot\u0101 t\u012bkl\u0101\u201d.<\/p>\n<p style=\"text-align: justify;\">Nedaudz groz\u012bts ar\u012b komerca\u0123enta iz\u0146\u0113muma<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> apjoms. Proti, komerca\u0123enta iz\u0146\u0113muma j\u0113dziens tiks s\u012bk\u0101k preciz\u0113ts, atsaucoties uz Direkt\u012bvu 86\/653\/EEK<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a>. \u0160\u012b direkt\u012bva ir transpon\u0113ta Latvij\u0101 ar Komerclikumu, kas VI sada\u013c\u0101 paredz skaidr\u0101ku izpratni par komerca\u0123enta statusu. Biznesa vien\u012bb\u0101m, kas pa\u013caujas uz \u0161o iz\u0146\u0113mumu, b\u016bs j\u0101nosl\u0113dz komerca\u0123enta l\u012bgums, paredzot re\u0101las ties\u012bbas apspriest, sagatavot vai ar\u012b nosl\u0113gtu dar\u012bjumu, kur\u0161 vi\u0146am uztic\u0113ts. Tom\u0113r j\u0101piebilst, ka l\u012bdzv\u0113rt\u012bgi \u0161\u012b br\u012b\u017ea interpret\u0101cijai tiks skaidri noteiks, ka \u0161is iz\u0146\u0113mums neattieksies uz e-komercijas platform\u0101m, kas darbojas k\u0101 komerca\u0123enti vienlaic\u012bi gan pirc\u0113ju, gan p\u0101rdev\u0113ju v\u0101rd\u0101.<\/p>\n<p style=\"text-align: justify;\">Paturot pr\u0101t\u0101 straujo tehnolo\u0123iju att\u012bst\u012bbu, Komisija ir preciz\u0113jusi tehnisko pakalpojumu nodro\u0161in\u0101t\u0101ju<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a> iz\u0146\u0113mumu. Proti, t\u0101di elektroniskie maki, k\u0101 piem\u0113ram GooglePay un ApplePay, kas ietver jau izsniegta maks\u0101\u0161anas instrumenta (piem\u0113ram, kred\u012btkartes) izmanto\u0161anu, netiks uzskat\u012bti par maks\u0101\u0161anas l\u012bdzekli, bet gan par maks\u0101jumu lietojumprogrammu, faktiski atst\u0101jot to operatorus \u0101rpus ar \u0161iem aktiem regul\u0113t\u0101s darb\u012bbas jomas.<\/p>\n<p style=\"text-align: justify;\"><strong>Skaidras naudas iz\u0146em\u0161anas pakalpojums bez licences sa\u0146em\u0161anas<\/strong><\/p>\n<p style=\"text-align: justify;\">PSR paredz ievest jaunievedumu mazumtirdzniec\u012bbas veikaliem. T\u0101diem veikaliem, kas pied\u0101v\u0101 skaidras naudas iz\u0146em\u0161anu bez pirkuma, neb\u016bs vajadz\u012bga licence vai at\u013cauja, ja skaidras naudas iz\u0146em\u0161ana notiks tikai to telp\u0101s un nep\u0101rsniegs 50 eiro apjomu.<\/p>\n<p style=\"text-align: justify;\"><strong>Darb\u012bbas izbeig\u0161anas pl\u0101ns<\/strong><\/p>\n<p style=\"text-align: justify;\">Neraugoties uz to, ka da\u017eas dal\u012bbvalstis ir jau iepriek\u0161 pras\u012bju\u0161as maks\u0101jumu iest\u0101d\u0113m izstr\u0101d\u0101t darb\u012bbas izbeig\u0161anas pl\u0101nu k\u0101 da\u013cu no licences pieteikuma, PSD3 tagad piepras\u012bs, lai visiem pieteikuma licences sa\u0146em\u0161anai iesniedz\u0113jiem pieteikuma paket\u0113 b\u016btu ar\u012b darb\u012bbas izbeig\u0161anas pl\u0101ns. \u0160im dokumentam b\u016btu j\u0101izkl\u0101sta scen\u0101rijs maks\u0101jumu iest\u0101des neveiksmes gad\u012bjum\u0101 (tostarp parast\u0101s uz\u0146\u0113m\u0113jdarb\u012bbas nep\u0101rtraukt\u012bba un atjauno\u0161ana) un vajadz\u0113tu b\u016bt piem\u0113rotam, lai veiktu darb\u012bbas p\u0101rtrauk\u0161anu saska\u0146\u0101 ar piem\u0113rojamiem valsts ties\u012bbu aktiem.<\/p>\n<p style=\"text-align: justify;\"><strong>Klientu l\u012bdzek\u013cu aizsardz\u012bbas pras\u012bbas<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a><\/strong><\/p>\n<p style=\"text-align: justify;\">Maks\u0101jumu iest\u0101d\u0113m b\u016bs j\u0101izvair\u0101s no koncentr\u0101cijas riska, sarg\u0101jot klientu l\u012bdzek\u013cus vair\u0101k nek\u0101 vien\u0101 kred\u012btiest\u0101d\u0113 vai alternat\u012bvi, turot tos centr\u0101laj\u0101 bank\u0101.
