Darba likuma (DL)\u00a0<a href=\"https:\/\/likumi.lv\/ta\/id\/26019-darba-likums#p149\" target=\"_blank\" rel=\"noopener\">149.panta<\/a>\u00a0redakcija ir balst\u012bta uz min\u0113t\u0101s direkt\u012bvas 7.pantu, kur\u0101 noteikts Eiropas Savien\u012bbas dal\u012bbvalstu pien\u0101kums nodro\u0161in\u0101t katra darba \u0146\u0113m\u0113ja ties\u012bbas uz apmaks\u0101tu ikgad\u0113ju atva\u013cin\u0101jumu, kas nedr\u012bkst b\u016bt \u012bs\u0101ks par \u010detr\u0101m kalend\u0101raj\u0101m ned\u0113\u013c\u0101m, k\u0101 ar\u012b tas, ka \u0161o laikposmu nevar aizst\u0101t ar finansi\u0101lu atl\u012bdz\u012bbu, iz\u0146emot gad\u012bjumus, kad darba attiec\u012bbas tiek p\u0101rtrauktas.<\/p>\n<p><strong>Atl\u012bdzin\u0101\u0161anas periods<\/strong><\/p>\n<p>Saska\u0146\u0101 ar DL\u00a0<a href=\"https:\/\/likumi.lv\/ta\/id\/26019-darba-likums#p149\" target=\"_blank\" rel=\"noopener\">149.panta<\/a>\u00a05.da\u013cu, ja darba attiec\u012bbu izbeig\u0161anas br\u012bd\u012b darbiniekam ir palicis neizmantots ikgad\u0113jais atva\u013cin\u0101jums, tas atl\u012bdzin\u0101ms naud\u0101, turkl\u0101t darba dev\u0113jam ir pien\u0101kums izmaks\u0101t atl\u012bdz\u012bbu par visu periodu, par kuru darbinieks to nav izmantojis. \u0160\u0137ietami saprotamais regul\u0113jums da\u017e\u0101d\u0101s dz\u012bves situ\u0101cij\u0101s tom\u0113r var rad\u012bt neskaidr\u012bbas. T\u0101d\u0113\u013c svar\u012bgi \u0146emt v\u0113r\u0101 tiesu praksi, kur\u0101 atrodami DL normas skaidrojumi.<\/p>\n<p>Praks\u0113 tie\u0161i situ\u0101cij\u0101s, kad tiek izbeigtas darba attiec\u012bbas, darba dev\u0113jiem rodas neskaidr\u012bbas, vai DL\u00a0<a href=\"https:\/\/likumi.lv\/ta\/id\/26019-darba-likums#p149\" target=\"_blank\" rel=\"noopener\">149.panta<\/a>\u00a05.da\u013c\u0101 min\u0113tais\u00a0<em>viss periods, par kuru darbinieks nav izmantojis ikgad\u0113jo apmaks\u0101to atva\u013cin\u0101jumu<\/em>\u00a0ir saprotams k\u0101 piln\u012bgi viss darbinieka uzkr\u0101tais atva\u013cin\u0101jums vai ar\u012b ir piem\u0113rojams noilgums, kas \u013cautu kompens\u0113t darbiniekam tikai p\u0113d\u0113jo divu gadu neizmantoto atva\u013cin\u0101jumu. \u012as\u0101 atbilde ir, ka j\u0101kompens\u0113 piln\u012bgi viss uzkr\u0101tais atva\u013cin\u0101jums, ja vien darba dev\u0113js nevar pier\u0101d\u012bt, ka ir akt\u012bvi r\u012bkojies, lai nos\u016bt\u012btu darbinieku atva\u013cin\u0101jum\u0101, un br\u012bvdienas nav izmantotas darbinieka vainas d\u0113\u013c.<\/p>\n<p><strong>Darba dev\u0113ja atbild\u012bba<\/strong><\/p>\n<p>Svar\u012bgi atcer\u0113ties, ka par darbinieka r\u012bc\u012bbas pier\u0101d\u012b\u0161anu, kas \u013cautu dro\u0161i anul\u0113t darbinieka uzkr\u0101t\u0101s atva\u013cin\u0101juma dienas un samazin\u0101t izmaks\u0101jamo kompens\u0101ciju, atbild\u012bgs ir darba dev\u0113js. Lai ar\u012b DL tas nav noteikts burtiski, darba dev\u0113jam ir pien\u0101kums uzraudz\u012bt darbinieku atp\u016btas laika izmanto\u0161anu un veicin\u0101t do\u0161anos ikgad\u0113j\u0101 atva\u013cin\u0101jum\u0101. Tas izriet gan no atva\u013cin\u0101juma oblig\u0101tuma rakstura, gan no EST judikat\u016bras.<\/p>\n<p>T\u0101tad jebkura komunik\u0101cija par atva\u013cin\u0101juma izmanto\u0161anu j\u0101veic rakstveid\u0101 un sistem\u0101tiski j\u0101fiks\u0113. B\u016btu ieteicams izstr\u0101d\u0101t noteikumus par atva\u013cin\u0101juma pieteik\u0161anas un izmanto\u0161anas k\u0101rt\u012bbu, iek\u013caujot nosac\u012bjumus par atva\u013cin\u0101juma dz\u0113\u0161anu, ja darbinieks apzin\u0101ti to neizmanto. Ar \u0161iem noteikumiem b\u016btu j\u0101iepaz\u012bstina visi darbinieki. Tom\u0113r tikai noteikumu esam\u012bba vien pati par sevi neko nerisin\u0101s.<\/p>\n<p>Atsaucoties uz jaun\u0101ko EST tiesu praksi, Sen\u0101ts 2019.gada 29.marta\u00a0<a href=\"https:\/\/www.at.gov.lv\/downloadlawfile\/5769\" target=\"_blank\" rel=\"noopener\">spriedum\u0101 liet\u0101 SKC-62\/2019<\/a>\u00a0nor\u0101d\u012bjis, ka darba dev\u0113jam ir form\u0101li j\u0101mudina darbinieks izmantot atva\u013cin\u0101jumu, prec\u012bzi un savlaic\u012bgi inform\u0113jot to, ka neizmanto\u0161anas gad\u012bjum\u0101 atva\u013cin\u0101jums tiks zaud\u0113ts. Savuk\u0101rt darbiniekiem j\u0101atceras, ka savas ties\u012bbas j\u0101izmanto lab\u0101 tic\u012bb\u0101.
