Rietumeiropas valstis pauda ba\u017eas, ka Austrumeiropas p\u0101rvad\u0101t\u0101ji izmanto zem\u0101s darbasp\u0113ka izmaksas un elast\u012bg\u0101ku normat\u012bvo regul\u0113jumu, lai g\u016btu priek\u0161roc\u012bbas tirg\u016b. Lai mazin\u0101tu past\u0101vo\u0161o spriedzi, 2000.gad\u0101 Eiropas Parlaments (EP) un Eiropas Komisija pie\u0146\u0113ma Mobilit\u0101tes pakotni.<\/p>\n<p><strong>Mobilit\u0101tes pakotni v\u0113rt\u0113 at\u0161\u0137ir\u012bgi<\/strong><\/p>\n<p>Mobilit\u0101tes pakotne ir pas\u0101kumu kopums, kas paredz\u0113ts autovad\u012bt\u0101ju darba apst\u0101k\u013cu uzlabo\u0161anai, taisn\u012bgas konkurences veicin\u0101\u0161anai un vienotas transporta politikas izveidei vis\u0101 ES. T\u0101 ietver vair\u0101kas ES regulas autotransporta jom\u0101, ar kur\u0101m tiek ieviests vienots regul\u0113jums t\u0101dos jaut\u0101jumos k\u0101 kravas autovad\u012bt\u0101ju atp\u016btas laiks, kabot\u0101\u017eas oper\u0101ciju ierobe\u017eojumi, darbinieku nos\u016bt\u012b\u0161anas regul\u0113juma piem\u0113ro\u0161ana autovad\u012bt\u0101jiem, pras\u012bbas transportl\u012bdzek\u013ciem atgriezties uz\u0146\u0113muma darb\u012bbas centr\u0101 u.c.<\/p>\n<p>Daudzu Austrumeiropas un ar\u012b Baltijas valstu p\u0101rvad\u0101t\u0101ji iebilda pakotn\u0113 noteiktaj\u0101m pras\u012bb\u0101m, nor\u0101dot, ka t\u0101s rad\u012bs papildu izdevumus. \u012apa\u0161i kritiz\u0113ta tika darba samaksas harmoniz\u0101cija un regul\u0101ra transportl\u012bdzek\u013cu atgrie\u0161an\u0101s uz\u0146\u0113muma darb\u012bbas centr\u0101. Vi\u0146i nor\u0101d\u012bja, ka jaunie noteikumi aizsarg\u0101 viet\u0113jos uz\u0146\u0113mumus no zem\u0101k atalgotajiem Austrumeiropas autovad\u012bt\u0101jiem. Turkl\u0101t pras\u012bbas par autovad\u012bt\u0101ju izmitin\u0101\u0161anu un regul\u0101ru atp\u016btu \u0101rpus transportl\u012bdzek\u013ciem tika uzsv\u0113rtas k\u0101 b\u016btiskas autovad\u012bt\u0101ju labkl\u0101j\u012bbas uzlabo\u0161anai.<\/p>\n<p><strong>EST p\u0101rv\u0113rt\u0113 pakotnes pamatnoteikumus<\/strong><\/p>\n<p>Vair\u0101kas valstis \u2013 Lietuva, Bulg\u0101rija, Kipra, Ung\u0101rija, Malta un Polija \u2013 iebilda pret Mobilit\u0101tes pakotn\u0113 ietvertaj\u0101m pras\u012bb\u0101m un apstr\u012bd\u0113ja t\u0101s EST (2024.gada 4.oktobra apvienot\u0101s lietas C\u2011541\/20 \u2013 C\u2011555\/20). Vi\u0146i nor\u0101d\u012bja, ka \u0161\u012bs pras\u012bbas neatbilst ES klimata politikai, jo var m\u0101ksl\u012bgi palielin\u0101t tuk\u0161o braucienu skaitu, t\u0101d\u0113j\u0101di negat\u012bvi ietekm\u0113jot vidi. Turkl\u0101t pieteic\u0113ji izteica ar\u012b ba\u017eas, ka \u0161ie noteikumi var pasliktin\u0101t ce\u013cu satiksmes dro\u0161\u012bbu un nevajadz\u012bgi apgr\u016btin\u0101t nozari. Noteikums par transportl\u012bdzek\u013ca atgrie\u0161anos uz\u0146\u0113muma darb\u012bbas centr\u0101 vismaz reizi asto\u0146\u0101s ned\u0113\u013c\u0101s \u012bpa\u0161i negat\u012bvi ietekm\u0113 tie\u0161i ES perif\u0113r\u0101s valstis, jo ce\u013co\u0161ana uz \u0161\u012bm valst\u012bm prasa vair\u0101k laika.<\/p>\n<p><strong>EST secin\u0101jumi<\/strong><\/p>\n<p>EST atst\u0101ja sp\u0113k\u0101 teju visus pieteic\u0113ju apstr\u012bd\u0113tos pakotnes noteikumus, apstiprinot, ka tie atbilst proporcionalit\u0101tes, vienl\u012bdz\u012bgas attieksmes un citiem pamatprincipiem. Tom\u0113r noteikumu, kas paredz\u0113ja transportl\u012bdzek\u013cu pien\u0101kumu vismaz reizi asto\u0146\u0101s ned\u0113\u013c\u0101s atgriezties uz\u0146\u0113muma darb\u012bbas centr\u0101, EST atc\u0113la. Tiesa nor\u0101d\u012bja, ka EP un ES Padome nav pietiekami izv\u0113rt\u0113ju\u0161as \u0161\u012b noteikuma sam\u0113r\u012bgumu, \u012bpa\u0161i t\u0101 ekonomisko, vides un soci\u0101lo ietekmi. Tie p\u0113t\u012bjumi un dati, uz kuriem ES iest\u0101des atsauc\u0101s, EST ieskat\u0101 nebija pietiekami, jo tajos nebija izv\u0113rt\u0113ta tie\u0161i \u0161\u012b konkr\u0113t\u0101 noteikuma ietekme.<\/p>\n<p>EST uzsv\u0113ra, ka pakotnes m\u0113r\u0137is ir pan\u0101kt r\u016bp\u012bgu l\u012bdzsvaru starp konkur\u0113jo\u0161\u0101m interes\u0113m transporta nozar\u0113. Tiesa atzina, ka da\u017eu transporta uz\u0146\u0113mumu izmaksu pieaugums ir attaisnojams ar m\u0113r\u0137i padar\u012bt nozari dro\u0161\u0101ku, efekt\u012bv\u0101ku un soci\u0101li atbild\u012bg\u0101ku. Tas ietver l\u012bdzsvaro\u0161anu starp autovad\u012bt\u0101ju vajadz\u012bb\u0101m p\u0113c lab\u0101kiem darba apst\u0101k\u013ciem un darba dev\u0113ju interes\u0113m saglab\u0101t god\u012bgus komercdarb\u012bbas nosac\u012bjumus. EST noraid\u012bja apgalvojumus par noteikumu diskrimin\u0113jo\u0161o raksturu, pat ja tie vair\u0101k ietekm\u0113ja uz\u0146\u0113mumus no ES perif\u0113raj\u0101m valst\u012bm. Tiesa nor\u0101d\u012bja, ka \u0161\u0101da ietekme izriet no \u0161o uz\u0146\u0113mumu izv\u0113l\u0113tajiem uz\u0146\u0113m\u0113jdarb\u012bbas mode\u013ciem, nevis no noteikumu m\u0113r\u0137a vai satura. EST uzsv\u0113ra, ka ikvienam uz\u0146\u0113mumam ir br\u012bv\u012bba dibin\u0101t meitas uz\u0146\u0113mumus cit\u0101s dal\u012bbvalst\u012bs, lai lab\u0101k apkalpotu savus tirgus.<\/p>\n<p>Attiec\u012bb\u0101 uz aizliegumu pavad\u012bt regul\u0101ros ikned\u0113\u013cas atp\u016btas periodus transportl\u012bdzekl\u012b EST nor\u0101d\u012bja, ka tas tikai apstiprina jau eso\u0161os noteikumus. Savuk\u0101rt pras\u012bba autovad\u012bt\u0101jiem regul\u0101ri atgriezties uz\u0146\u0113muma darb\u012bbas centr\u0101 vai sav\u0101 dz\u012bvesviet\u0101 tika atz\u012bta par pietiekami elast\u012bgu, lai dotu iesp\u0113ju izv\u0113l\u0113ties \u0113rt\u0101ko risin\u0101jumu, vienlaikus sasniedzot soci\u0101l\u0101s aizsardz\u012bbas m\u0113r\u0137us.
