Viena no \u0161\u0101du kol\u012bziju atrisin\u0101\u0161anas pamatmetod\u0113m paredz \u2013 ja konstat\u0113 pretrunu starp da\u017e\u0101da juridisk\u0101 sp\u0113ka ties\u012bbu norm\u0101m, piem\u0113ro to ties\u012bbu normu, kurai ir augst\u0101ks juridiskais sp\u0113ks.<\/p>\n<p>Ties\u012bbu normu hierarhij\u0101 pa\u0161vald\u012bbu saisto\u0161ajiem noteikumiem ir viszem\u0101kais juridiskais sp\u0113ks. L\u012bdz ar to gad\u012bjumos, kad, piem\u0113ram, pa\u0161vald\u012bbas regul\u0113jums non\u0101k pretrun\u0101 MK noteikumiem vai likumam, priek\u0161roka tiks dota MK noteikumu vai likuma ties\u012bbu norm\u0101m.<\/p>\n<p>Tom\u0113r, pirms piem\u0113rot ties\u012bbu normu kol\u012bzijas atrisin\u0101\u0161anas metodes, vispirms j\u0101noskaidro, vai starp ties\u012bbu norm\u0101m patie\u0161\u0101m veidojas kol\u012bzija. T\u0101d\u0113\u013c uzman\u012bbas cien\u012bgs ir Sen\u0101ta 2024.gada 11.apr\u012b\u013ca\u00a0<a href=\"https:\/\/www.at.gov.lv\/downloadlawfile\/10483\" target=\"_blank\" rel=\"noopener\">spriedums liet\u0101 SKA-150\/2024<\/a>, kur\u0101 tika risin\u0101tas pretrunas starp MK apstiprin\u0101tu b\u016bvnormat\u012bvu un pa\u0161vald\u012bbas teritorijas pl\u0101nojuma Teritorijas izmanto\u0161anas un apb\u016bves noteikumiem.<\/p>\n<p>Pirms piem\u0113rot ties\u012bbu normu kol\u012bzijas atrisin\u0101\u0161anas metodes, vispirms j\u0101noskaidro, vai starp ties\u012bbu norm\u0101m patie\u0161\u0101m veidojas kol\u012bzija.<\/p>\n<p><strong>Lietas apst\u0101k\u013ci<\/strong><\/p>\n<p>Tiesved\u012bbas pamat\u0101 bija daudzst\u0101vu daudzdz\u012bvok\u013cu dz\u012bvojam\u0101s m\u0101jas b\u016bvniec\u012bbas iecere. Att\u012bst\u012bt\u0101js M\u0101rupes novad\u0101 bija iepl\u0101nojis b\u016bv\u0113t \u010detru st\u0101vu dz\u012bvojamo \u0113ku ar jumta st\u0101vu, kur\u0101 izvietoti dz\u012bvok\u013ci.<\/p>\n<p>M\u0101rupes novada pa\u0161vald\u012bbas teritorijas pl\u0101nojuma Teritorijas izmanto\u0161anas un apb\u016bves noteikumi (Apb\u016bves noteikumi) paredz\u0113ja, ka teritorij\u0101, kur bija pl\u0101nots b\u016bv\u0113t dz\u012bvojamo \u0113ku, maksim\u0101lais st\u0101vu skaits ir \u010detri. Vienlaikus Apb\u016bves noteikumi noteica, ka jumta st\u0101vu neieskaita kop\u0113j\u0101 st\u0101vu skait\u0101, iz\u0146emot gad\u012bjumus, kad jumta st\u0101va plat\u012bba 2,5 metru augstum\u0101 p\u0101rsniedz 50% no \u0113kas pirm\u0101 st\u0101va plat\u012bbas. B\u016bvvalde piem\u0113roja MK noteikumu Nr.340 &#8220;Noteikumi par Latvijas b\u016bvnormat\u012bvu LBN 211-15 &#8220;Dz\u012bvojam\u0101s \u0113kas&#8221;&#8221;\u00a0<a href=\"https:\/\/likumi.lv\/ta\/id\/275016\/redakcijas-datums\/2020\/06\/20#p7\" target=\"_blank\" rel=\"noopener\">7.punktu<\/a>, kur\u0101 bija paredz\u0113ts, ka jumta st\u0101vs ir ieskait\u0101ms st\u0101vu skait\u0101, ja taj\u0101 ir ieb\u016bv\u0113tas dz\u012bvojam\u0101s telpas. T\u0101 k\u0101 pl\u0101not\u0101 b\u016bvniec\u012bbas iecere paredz\u0113ja dz\u012bvok\u013cu izvieto\u0161anu ar\u012b jumta st\u0101v\u0101, tad b\u016bvvalde secin\u0101ja, ka jumta st\u0101vs ir ieskait\u0101ms kop\u0113j\u0101 st\u0101vu skait\u0101 un b\u016bvniec\u012bbas iecere neatbilst Apb\u016bves noteikumu pras\u012bb\u0101m par maksim\u0101lo st\u0101vu skaitu.<\/p>\n<p>Att\u012bst\u012bt\u0101js nepiekrita b\u016bvvaldei un v\u0113rs\u0101s Administrat\u012bvaj\u0101 ties\u0101 ar pieteikumu par labv\u0113l\u012bga administrat\u012bv\u0101 akta \u2013 b\u016bvat\u013caujas \u2013 izdo\u0161anu. Att\u012bst\u012bt\u0101js uzskat\u012bja, ka, v\u0113rt\u0113jot kop\u0113j\u0101 st\u0101vu skaita atbilst\u012bbu pa\u0161vald\u012bbas teritorijas pl\u0101nojumam, ir j\u0101\u0146em v\u0113r\u0101 pa\u0161vald\u012bbas Apb\u016bves noteikumi, nevis b\u016bvnormat\u012bva regul\u0113jums.<\/p>\n<p>Tiesved\u012bbas laik\u0101 MK noteikumi Nr.340 zaud\u0113ja sp\u0113ku. Tom\u0113r ar\u012b to viet\u0101 pie\u0146emto MK noteikumu Nr.693 &#8220;B\u016bvju visp\u0101r\u012bgo pras\u012bbu b\u016bvnormat\u012bvs LBN 200-21&#8221;\u00a0<a href=\"https:\/\/likumi.lv\/ta\/id\/326992-buvju-visparigo-prasibu-buvnormativs-lbn-200-21#p9\" target=\"_blank\" rel=\"noopener\">9.punkt\u0101\u00a0<\/a>paredz\u0113ts, ka st\u0101vu skait\u0101 ieskaita visus izmantojamos virszemes st\u0101vus, tostarp jumta st\u0101vu. Lemjot par labv\u0113l\u012bga administrat\u012bv\u0101 akta izdo\u0161anu, ties\u0101m ir j\u0101piem\u0113ro lietas izskat\u012b\u0161anas laik\u0101 sp\u0113k\u0101 eso\u0161ais regul\u0113jums. T\u0101d\u0113\u013c tiesas piem\u0113roja \u0161obr\u012bd sp\u0113k\u0101 eso\u0161o b\u016bvnormat\u012bvu LBN 200-21.<\/p>\n<p>Rajona tiesa un ar\u012b apgabaltiesa noraid\u012bja att\u012bst\u012bt\u0101ja pieteikumu. Apgabaltiesa konstat\u0113ja, ka pa\u0161vald\u012bbas Apb\u016bves noteikumi un b\u016bvnormat\u012bvs LBN 200-21 paredz at\u0161\u0137ir\u012bgus noteikumus, p\u0113c kuriem ir nosak\u0101ms, vai jumta st\u0101vs ir ieskait\u0101ms kop\u0113j\u0101 st\u0101vu skait\u0101. Apgabaltiesa uzskat\u012bja, ka veidojas ties\u012bbu normu kol\u012bzija un Apb\u016bves noteikumu regul\u0113jums par jumta st\u0101va ieskait\u012b\u0161anu kop\u0113j\u0101 st\u0101vu skait\u0101 neatbilst b\u016bvnormat\u012bvam LBN 200-21. \u0145emot v\u0113r\u0101, ka b\u016bvnormat\u012bviem ir augst\u0101ks juridiskais sp\u0113ks, nek\u0101 pa\u0161vald\u012bbas Apb\u016bves noteikumiem, apgabaltiesa piem\u0113roja b\u016bvnormat\u012bvu LBN 200-21 un secin\u0101ja, ka b\u016bvniec\u012bbas iecere konkr\u0113taj\u0101 teritorij\u0101 nav at\u013cauta.<\/p>\n<p>Par apgabaltiesas spriedumu att\u012bst\u012bt\u0101js iesniedza kas\u0101cijas s\u016bdz\u012bbu.<\/p>\n<p>Ja pa\u0161vald\u012bbas teritorijas pl\u0101nojuma ties\u012bbu normas v\u0101rdiskais formul\u0113jums non\u0101k pretrun\u0101 augst\u0101ka juridisk\u0101 sp\u0113ka ties\u012bbu normai, vispirms ieteicams izv\u0113rt\u0113t katras ties\u012bbu normas m\u0113r\u0137i.<\/p>\n<p><strong>Sen\u0101ta secin\u0101jumi<\/strong><\/p>\n<p>Ar\u012b Sen\u0101ts 2024.gada 11.apr\u012b\u013ca spriedum\u0101 liet\u0101 SKA-150\/2024 konstat\u0113ja, ka Apb\u016bves noteikumos un b\u016bvnormat\u012bv\u0101 LBN 200-21 ir at\u0161\u0137ir\u012bgi regul\u0113ts jaut\u0101jums, vai un k\u0101d\u0101 gad\u012bjum\u0101 jumta st\u0101vs ir j\u0101ieskaita kop\u0113j\u0101 st\u0101vu skait\u0101. Tom\u0113r Sen\u0101ts secin\u0101ja, ka pretrunas jeb kol\u012bzija neveidojas.<\/p>\n<p>Lai noskaidrotu, vai starp Apb\u016bves noteikumiem un b\u016bvnormat\u012bvu LBN 200-21 patie\u0161\u0101m veidojas pretrunas, Sen\u0101ts v\u0113rt\u0113ja \u0161o regul\u0113jumu m\u0113r\u0137i. Sen\u0101ts konstat\u0113ja, ka BL un Teritorijas att\u012bst\u012bbas pl\u0101no\u0161anas likuma, proti, normat\u012bvo aktu, uz kuru pamata ir pie\u0146emts b\u016bvnormat\u012bvs LBN 200-21 un Apb\u016bves noteikumi, m\u0113r\u0137i ir savstarp\u0113ji cie\u0161i saist\u012bti. Ta\u010du b\u016bvnormat\u012bva LBN 200-21 un Apb\u016bves noteikumu m\u0113r\u0137i at\u0161\u0137iras.<\/p>\n<p>B\u016bvnormat\u012bvi tiek izdoti, pamatojoties uz BL\u00a0<a href=\"https:\/\/likumi.lv\/ta\/id\/258572-buvniecibas-likums#p5\" target=\"_blank\" rel=\"noopener\">5.panta\u00a0<\/a>1.da\u013cas 3.punktu, kas pilnvaro MK noteikt tehnisk\u0101s pras\u012bbas b\u016bv\u0113m un to elementiem, k\u0101 ar\u012b uz b\u016bv\u0113m attiecin\u0101mas vides pieejam\u012bbas pras\u012bbas. B\u016bvnormat\u012bva LBN 200-21\u00a0<a href=\"https:\/\/likumi.lv\/ta\/id\/326992-buvju-visparigo-prasibu-buvnormativs-lbn-200-21#p9#p1\" target=\"_blank\" rel=\"noopener\">1.punkt\u0101\u00a0<\/a>noteiktas pras\u012bbas, kuras iev\u0113ro, projekt\u0113jot \u0113kas, stadionus, ar\u0113nas, br\u012bvdabas estr\u0101des un citas br\u012bvdabas izklaides b\u016bves, k\u0101 ar\u012b pras\u012bbas to novieto\u0161anai, jaunai b\u016bvniec\u012bbai, atjauno\u0161anai, p\u0101rb\u016bvei un restaur\u0101cijai.<\/p>\n<p>No min\u0113t\u0101 Sen\u0101ts secin\u0101ja, ka b\u016bvnormat\u012bv\u0101 LBN 200-21 paredz\u0113tas tehnisk\u0101s pras\u012bbas, kas j\u0101iev\u0113ro, projekt\u0113jot noteikta veida b\u016bves. Tie\u0161i \u0161\u012b m\u0113r\u0137a kontekst\u0101 ir apl\u016bkojamas b\u016bvnormat\u012bva pras\u012bbas st\u0101vu skaita noteik\u0161anai. T\u0101d\u0113\u013c b\u016bvnormat\u012bv\u0101 LBN 200-21 paredz\u0113t\u0101s pras\u012bbas par \u0113kas kop\u0113jo st\u0101vu skaitu ir j\u0101\u0146em v\u0113r\u0101, ja, projekt\u0113jot \u0113ku, ir j\u0101iev\u0113ro specifiskas tehnisk\u0101s pras\u012bbas, kas attiecas uz attiec\u012bga augstuma (st\u0101vu skaita) \u0113k\u0101m.<\/p>\n<p>Savuk\u0101rt Apb\u016bves noteikumu 5.punkt\u0101 paredz\u0113ts, ka to m\u0113r\u0137is ir veicin\u0101t ilgtsp\u0113j\u012bgu un l\u012bdzsvarotu novada att\u012bst\u012bbu saska\u0146\u0101 ar M\u0101rupes novada teritorijas pl\u0101nojuma pras\u012bb\u0101m, nosakot zemes \u012bpa\u0161nieku un lietot\u0101ju b\u016bvties\u012bbas un pien\u0101kumus, lai veicin\u0101tu novada iedz\u012bvot\u0101ju vesel\u012bbu, dro\u0161\u012bbu, \u0113rt\u012bbas, visp\u0101r\u012bgu labkl\u0101j\u012bbu un vides intere\u0161u tiesisku l\u012bdzsvarot\u012bbu.
