Attiec\u012bgi gad\u012bjumos, kad \u0101rzemnieks ir darba, uz\u0146\u0113muma l\u012bguma vai autora l\u012bguma attiec\u012bb\u0101s ar instit\u016bciju vai Latvijas uz\u0146\u0113mumu, uz vi\u0146u attiecin\u0101mie dokumenti ir glab\u0101jami un arhiv\u0113jami Latvij\u0101.<\/p>\n<h4><span style=\"color: #9fffec;\"><strong>Kad dokumenti j\u0101glab\u0101 \u0101rvalst\u012bs<\/strong><\/span><\/h4>\n<p>K\u0101 r\u012bkoties ar \u0101rzemnieku darba gaitu dokumentiem, kas rodas Latvij\u0101 \u0101rpus min\u0113taj\u0101m attiec\u012bb\u0101m? Te izce\u013camas t\u0101das nodarbin\u0101t\u012bbas formas k\u0101 p\u0101rcel\u0161ana vienas komersantu grupas ietvaros, darba izpilde, nodro\u0161inot starptautisku pakalpojumu, un darbinieku iznom\u0101\u0161ana. B\u016btiski, ka Latvijas puse, sagatavojot dokumentus, darbosies k\u0101 \u0101rvalstu darba dev\u0113ja pilnvarnieks un dokumenti b\u016bs izdoti t\u0101 v\u0101rd\u0101. Tas noz\u012bm\u0113, ka dokumenti nav glab\u0101jami MK noteikumu Nr.690 k\u0101rt\u012bb\u0101 un tie b\u016bs tie\u0161i tikpat mobili k\u0101 pats \u0101rzemnieks.<\/p>\n<p>Latvijas puse saska\u0146\u0101 ar Visp\u0101r\u012bg\u0101s datu aizsardz\u012bbas regulas (regula 2016\/679 par fizisku personu aizsardz\u012bbu attiec\u012bb\u0101 uz personas datu apstr\u0101di un \u0161\u0101du datu br\u012bvu apriti)\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2016\/679\/oj\/?locale=LV#art_5\" target=\"_blank\" rel=\"noopener\">5.panta<\/a>\u00a01.punkta e) apak\u0161punktu nedr\u012bkst k\u013c\u016bt par \u0161\u012bs kategorijas \u0101rzemnieku dokumentu glab\u0101t\u0101ju. Latvijas pusei personas darba gaitas apliecino\u0161ie dokumenti savstarp\u0113ju saist\u012bbu ietvaros j\u0101nodod \u0101rzemnieka darba dev\u0113jam un j\u0101glab\u0101 tikai tik ilgi, cik tas nepiecie\u0161ams savu le\u0123it\u012bmo intere\u0161u aizsardz\u012bbai iesp\u0113jama str\u012bda gad\u012bjum\u0101.<\/p>\n<p>Da\u013c\u0101 no \u0161\u0101das nodarbin\u0101t\u012bbas gad\u012bjumiem Latvija b\u016bs \u0161o personu darba gaitu apliecino\u0161o dokumentu kontroles punkts. T\u0101 tas ir gad\u012bjumos, kad uz Latviju p\u0101rcelti vai izpild\u012bt darbu nos\u016bt\u012bti Eiropas Savien\u012bbas (ES) vai Eiropas Ekonomikas zonas (EEZ) valst\u012bs re\u0123istr\u0113to uz\u0146\u0113mumu darbinieki \u2013 \u0101rzemnieki. Saska\u0146\u0101 ar Darba likuma (DL)\u00a0<a href=\"https:\/\/likumi.lv\/ta\/id\/26019-darba-likums\/#p14_1\" target=\"_blank\" rel=\"noopener\">14.<sup>1<\/sup>panta\u00a0<\/a>6. un 7.da\u013cu ES vai EEZ darba dev\u0113js, kas nos\u016bta, iznom\u0101 vai p\u0101rce\u013c savu darbinieku uz Latviju, ir atbild\u012bgs par \u0101rzemnieka person\u0101la dokumentu \u2013 darba l\u012bguma kopijas, darba laika uzskaites dokumentu, algas apr\u0113\u0137inu un izmaksas dokumentu \u2013 glab\u0101\u0161anu pie sava pilnvarot\u0101 p\u0101rst\u0101vja uzr\u0101d\u012b\u0161anai Valsts darba inspekcijai (VDI) p\u0113c piepras\u012bjuma. \u0160ie dokumenti glab\u0101jami Latvij\u0101, to glab\u0101\u0161ana uzr\u0101d\u012b\u0161anai ir \u0101rvalstu darba dev\u0113ja un nevis Latvijas puses pien\u0101kums, un tas ir sp\u0113k\u0101 v\u0113l 2 gadus p\u0113c \u0101rzemnieka izce\u013co\u0161anas.<\/p>\n<p>Cik ilgi personas darba gaitas apliecino\u0161ie dokumenti, kas nodoti \u0101rzemnieka \u0101rvalstu darba dev\u0113jam, glab\u0101jami \u0101rvalst\u012bs? K\u0101 labs piem\u0113rs var kalpot valsts, ko var\u0113tu saukt par prec\u012bzas, racion\u0101las un efekt\u012bvas birokr\u0101tijas citadeli. T\u0101 ir V\u0101cija. Atbilsto\u0161i V\u0101cijas nodok\u013cu kodeksa 147.panta 1. un 3.da\u013cai darba gaitas apliecino\u0161ie dokumenti darba dev\u0113jam j\u0101glab\u0101 6 gadus, skaitot \u0161o termi\u0146u no darba attiec\u012bbu izbeig\u0161anas kalend\u0101r\u0101 gada beig\u0101m.<\/p>\n<p>Gr\u0101matved\u012bbas dokumenti par \u0101rzemnieku darbu un atl\u012bdz\u012bbu glab\u0101jami Gr\u0101matved\u012bbas likuma (GL)\u00a0<a href=\"https:\/\/likumi.lv\/ta\/id\/324249-gramatvedibas-likums\/#p28\" target=\"_blank\" rel=\"noopener\">28.panta<\/a>\u00a03., 4. un 5.punkt\u0101 noteiktaj\u0101 k\u0101rt\u012bb\u0101. Glab\u0101\u0161anas ilgums b\u016bs atkar\u012bgs gan no dokumenta rad\u012b\u0161anas laika un veida, gan no t\u0101, vai tas attiecin\u0101ms tie\u0161i uz darbiniekam izmaks\u0101to atl\u012bdz\u012bbu par darbu, k\u0101 ar\u012b no t\u0101, vai dokuments vajadz\u012bgs, lai uzraugo\u0161\u0101s iest\u0101des var\u0113tu izsekot saimniecisk\u0101 dar\u012bjuma norisei.<\/p>\n<p>Da\u017ei piem\u0113ri:<\/p>\n<ul class=\"chevronCircle\">\n<li>darba laika uzskaites tabeles glab\u0101jamas vismaz 5 gadus;<\/li>\n<li>darbinieku iesniegumi par atva\u013cin\u0101jumu pie\u0161\u0137ir\u0161anu \u2013 10 gadus, ja to datums ir 1999.gada 1.janv\u0101ris vai v\u0113l\u0101ks, vai 75 gadus, ja agr\u0101ks;<\/li>\n<li>uz\u0146\u0113muma vai autora l\u012bguma ietvaros veiktie maks\u0101jumi \u2013 ne maz\u0101k k\u0101 5 gadus.<\/li>\n<\/ul>\n<p>Vienlaikus j\u0101atz\u012bm\u0113, ka gad\u012bjumos, kad \u0101rzemnieki veic darbu Latvij\u0101 un ir darba attiec\u012bb\u0101s ar \u0101rvalstu darba dev\u0113ju, gr\u0101matved\u012bbas dokumenti par \u0101rzemnieka darbu un atl\u012bdz\u012bbu, ja t\u0101di Latvij\u0101 radu\u0161ies, j\u0101glab\u0101 div\u0101s valst\u012bs vienlaic\u012bgi \u2013 Latvij\u0101 saska\u0146\u0101 ar GL, un \u0101rvalst\u012bs saska\u0146\u0101 ar konkr\u0113t\u0101s valsts normat\u012bvajiem aktiem. P\u0113c tam tos nodod arh\u012bv\u0101 atbilsto\u0161i normat\u012bvajiem aktiem par dokumentu glab\u0101\u0161anu un nodo\u0161anu arh\u012bv\u0101. Gad\u012bjum\u0101, ja \u0101rzemnieks Latvij\u0101 tikai izpilda darbu, bet ir darba attiec\u012bb\u0101s ar \u0101rvalstu darba dev\u0113ju, tad dokumentu kopijas nos\u016bt\u0101mas glab\u0101\u0161anai ar\u012b \u0101rzemnieka darba dev\u0113jam.<\/p>\n<h4><span style=\"color: #9fffec;\"><strong>Intere\u0161u aizsardz\u012bbas m\u0113r\u0137is<\/strong><\/span><\/h4>\n<p>Pie person\u0101la dokumentiem, kuru glab\u0101\u0161anas termi\u0146i nav stingri reglament\u0113ti, minami kandid\u0101tu CV, motiv\u0101cijas v\u0113stules, rekomend\u0101cijas v\u0113stules, konkursa ietvaros izpild\u012btie uzdevumi, karjeras pl\u0101no\u0161anas un ikgad\u0113j\u0101s nov\u0113rt\u0113\u0161anas dokumenti, disciplin\u0101rlietas dokumenti, darbinieku s\u016bdz\u012bbas un taml\u012bdz\u012bgi dokumenti. Paradoks\u0101li, ka valsts nedz instit\u016bcij\u0101m, nedz uz\u0146\u0113mumiem \u0161\u0101du dokumentu glab\u0101\u0161anu nepieprasa, lai gan paties\u012bb\u0101 vairums no tiem par darbinieku pasaka daudz vair\u0101k nek\u0101 darba l\u012bgumi un amata apraksti. Tie\u0161i pret\u0113ji \u2013 atsevi\u0161\u0137os gad\u012bjumos \u0161ie dokumenti j\u0101izn\u012bcina iesp\u0113jami \u0101tr\u0101k.<\/p>\n<p>Ja amata kandid\u0101ts nav iztur\u0113jis konkursu, tad person\u0101la dokumenti glab\u0101jami ne ilg\u0101k par 6 m\u0113ne\u0161iem. Atkal j\u0101saka, ka Latvija nediskrimin\u0113 \u2013 izn\u012bcin\u0101mi k\u0101 viet\u0113jo, t\u0101 ar\u012b \u0101rvalstu darbinieku person\u0101la dokumenti.<\/p>\n<p>Ja \u0101rzemnieks nav bijis nodarbin\u0101ts, pamatojoties uz darba l\u012bgumu, autora l\u012bgumu vai uz\u0146\u0113muma l\u012bgumu, kas nosl\u0113gts ar Latvijas instit\u016bciju vai uz\u0146\u0113mumu, tad \u0161\u012bs kategorijas dokumentu glab\u0101\u0161ana ir \u0101rvalstu darba dev\u0113ja pien\u0101kums.
