Terminal’s dispute with Olerex ended positively for Terminal

Olerex filed a claim against Terminal and its management board member, stating that a sentence published by the Estonian Public Broadcasting’s article about Olerex causing at least 100 million euros of damages by breaching the biofuel obligation was an incorrect factual statement or alternatively defamation.
Terminal did not accept the claim and found that what was published in the article cannot be considered as a fact, but value judgement, which was appropriate. Therefore, Olerex’s claims were not justified.
As a result of the court dispute, the parties concluded a compromise, where they agreed that an explanation will be published on what was meant by the published statement – that it was indeed a value judgement.
Therefore and as a result of the court proceedings, it was not found that Terminal or its management board member had published incorrect facts or made defamatory statements, nor were they obliged to overturn them.
