Holders of firearms licences must submit an application to the Estonian Police and Border Guard Board (PPA) by the statutory deadline to extend the validity of their licence, together with a medical certificate and all other required documents.
Due to an unexpected illness and lengthy medical waiting times, Tigris Nõgols was forced to submit the required documents to the PPA with a short delay. The PPA, however, refused to review the extension application of the firearms licence, arguing that there was no valid reason for the late submission.
Tigris Nõgols challenged the PPA’s decision in court, arguing that the deadline should be reinstated because the delay was caused by a justified reason, illness and long medical queues, and that there was no basis for refusing to extend the licence under such circumstances. Both the Administrative Court and the Circuit Court agreed with Nõgols, annulled the PPA’s decision, and ordered the PPA to review the extension application.
