Soon the Estonian competition enforcement system is about to change dramatically and therefore it´s a good time for reflection.

Our Partner and competition law expert Elo Tamm wrote an article for the Finnish Competition Law Association Yearbook, where she reviews the enforcement system and points out its bottlenecks.

Currently, companies can be held liable for competition law violations in different proceedings. Until now, the Estonian Competition Authority has followed an administrative enforcement system,  which has not enabled the application of significant sanctions. However, the companies are often unclear on what their rights in the proceedings are. Elo discusses the problems associated with multiple proceedings, as well as other current competition law topics.

It remains to be seen quite soon, whether a new chapter on Estonian competition enforcement is opened with high fines, whether enforcement proceedings will become clearer, or we will see many features of the old system remaining in place.
