COBALT represents a client in a dispute with the Estonian Police and Border Guard Board

Senior associate Kadri Michelson is representing a client in an administrative matter, where the client filed an appeal against the Estonian Police and Border Guard Board’s decision refusing to issue her the residence permit.

This is a constitutional dispute where the main emphasis is on the question whether the Aliens Act is compatible with the Constitution of the Republic of Estonia, by excluding the possibility to apply for a residence permit to settle with minor child and partner who are Estonian citizens.

The restriction imposed by the Aliens Act is a heavy intervention to family life, the necessity of which must be extremely justified. Without mentioning that it is in principle questionable whether such rigid regulation is at all justified and necessary in today’s cultural and legal space.
